I’m sure she’d settle for less.
That didn’t take long.
She has a point though.
No. Failing to act on it most certainly is.
What of the survivors of those killed?
So maybe Wal-mart had given him notice and told him he was sacked and that’s what triggered the gunman…
Did Wallmart open fire and shoot her? Oh, it was a crazed gunman?
No case.
“Despite Mr. Bing’s long-standing pattern of disturbing and threatening behavior, Walmart knew or should have known about Mr. Bing’s disturbing and threatening behavior, but failed to terminate Mr. Bing, restrict his access to common areas, conduct a thorough background investigation, or subject him to a mental health examination,” the lawsuit states.
In addition, the complaint alleges that Bing “repeatedly made veiled threats of violence,” stating that people will “remember [his] name” if he was ever fired and ominously asking employees if they had received their active shooter training.”
The first part needs to be proved Walmart didn’t do any of this because it is confidential. Also, is that part of the protocol or just her opinion of what should have happened? And, is the second part in writing?
And what was Walmart supposed to do? Even if they banned him from the store, they can’t enforce it.
This whole episode will prolly cost Wally $1 billion plus.
Was she even on-site that day?
The case will be dismissed. She has a workers comp case. She can’t sue in Civil Court.
Probably better WM did nothing. Imagine the carnage if they had fired him because of the complaint.
She won’t get $50 million, but if there is documentation about a complaint and it wasn’t acted upon…WalMart will be settling for a lot of money.
What did Walmart do? It happened on their property I’m sure they have liability insurance of this probably isn’t much of a dent.
I think Walmart’s have a sign about the Corporate pride of being a gun-free zone... so that was easily thwarted. Other than that no other people were allowed to carry and put these scenarios to an end, quickly?
If Wal-Mart knew this shooter was a problem child and did nothing about it, they should indeed be liable.
Knowing WM their legion of lawyers will fight her tooth and nail. WM has decades of experience fending off slip and fall artists.
FWIW - keep copies of any such correspondence with an employer. Keep dated, contemporaneous notes of any episodes. (Keep a little pocket notebook, if need be). Keep backup copies off-site.
Yeah, she’s got a case imo
I hope she kept a date, and time stamped copy of that complaint she filed with Walmart about Bing, two months prior to the shooting.
