Linn County Sheriff Michelle Duncan is making clear her office will not be enforcing Oregon’s new “high capacity” magazine ban.
The ban is part of Ballot Measure 114 (BM 114), which was heavily funded by out-of-state money.

An unjust law is no law at all.
Oregon’s law(s) about gun control are trying to force sheriffs to carry much of the burden, and private citizens the rest. The laws are unfunded mandates that will force sheriffs to deal with permitting and background checks, which mean hiring more staff at a time when hiring personnel is difficult already.
My coastal county has a serious crime problem, and catch-and-release policy, due to the county jail refusing new inmates. And a 5 year bond measure to add 50 beds just failed.
Laws that are repugnant to the Constitution are null and void.
Music to my ears on Veterans Day.
We have some decent Sheriffs in Oregon. Their non-enforcemdnt of this abomination will be limited to the “ high-capacity” magazine ban. With the feds thoroughly involved in firearm transfers, there’s no getting around the permit-to-purchase system, save through the courts. I have no doubt that many municipal police forces, and Tina Kotek’s State police will have no qualms about enforcing the magazine ban.
Sheriffs and fully informed juries are both important. If they can’t get a conviction, the law has no teeth.
“...fully informed juries...”
GOOD LUCK making THAT happen in a Court of Law; you’ll get rung up for Contempt if you even THINK “nullification.”
That's because courts are afraid of anything that threatens their authority. As a member of a jury they cannot make you vote in any particular way.
If you stand your ground they can call a mistrial, but they cannot force you to convict.
That’s true for members of the jury, not for attorneys in open court. Attorneys can’t say Jack crap about nullification during proceedings. Liable to be disbarred. Whether it’s all true or not his entirely irrelevant. Judges don’t want to hear anything about it.
