Chief Justice John Roberts confirmed the authenticity of the leaked draft opinion indicating the Supreme Court would upend Roe v. Wade as he announced an investigation into the source of the 'betrayal.'
'To the extent this betrayal of the confidences of the Court was intended to undermine the integrity of our operations, it will not succeed. The work of the Court will not be affected in any way,' Roberts wrote in a Tuesday morning statement.
'We at the Court are blessed to have a workforce - permanent employees and law clerks alike - intensely loyal to the institution and dedicated to the rule of law. Court employees have an exemplary and important tradition of respecting the confidentiality of the judicial process and upholding the trust of the Court. This was a singular and egregious breach of that trust that is an affront to the Court and the community of public servants who work here.'
'I have directed the Marshal of the Court to launch an investigation into the source of the leak,' Roberts added.
Roberts said that though the document was authentic, it does not represent the 'final decision' of any members of the court.

But is the draft based on the votes of the Justices, or do they change their votes as other opinions are added? I always thought they took a vote, then assigned one of each side to write their opinion.
This is a nothing burger. If the wimpy judges, chief of whom is Roberts, were too scared to do anything about election fraud and the Constitutional issues involved in the Pennsylvania case, they certainly won’t do anything about Roe v Wade. Roberts will have another one of his screaming fits as he did with the election challenges. He’ll tell the junior justices to sit down and shut up. They’ll comply because they don’t want their houses fire bombed.
Roe v Wade will stand. Count on it.

It’s tantamount to an insurrection, in my opinion.
Leak will have its intended effect. Roe will be upheld 6-3 or 7-2. Only Thomas and Alito are sure votes...Gorsuch a maybe. Barret and Kavenaugh will vote with the Libs following the leak...maybe even Gorsuch.
Generally, the draft majority opinion means you have that many justices committed to that view, and it’s just a matter of refining the language. On rare occasions, a judge may flip their vote after seeing the draft. It also can impact whether concurring opinions are written, etc..
