Special Counsel John Durham has scored a victory over Hillary Clinton’s lawyer in court after a federal judge ruled against their motion to strike information from his February filing.
The federal judge presiding over the case of former Clinton campaign lawyer Michael Sussmann rejected his motion to “strike” the “factual background” section of Durham’s bombshell filing.
Sussmann’s legal team filed a motion demanding the court “strike” portions of Durham’s Feb. 11 filing because they claim it will “taint” a jury pool.
U.S. District Court for the District of Columbia Judge Christopher Cooper, an Obama appointee, rejected Hillary’s lawyer’s motion but did admonish Durham saying it wasn’t necessary to put all that detail in the factual background section.
“I didn’t see any link to areas that were relevant,” Judge Cooper said.
“I don’t know why the information was in there.
“I extend a presumption of good faith to all counsel, especially government counsel.
I’m not going to strike anything from the record.
“Whatever effect the filing has had has already passed.”
Sussmann’s legal team said Durham had “done more than simply file a document identifying potential conflicts of interest.”
Sussmann’s lawyers said:
“Rather, the special counsel has again made a filing in this case that unnecessarily includes prejudicial — and false — allegations that are irrelevant to his motion and to the charged offense, and are plainly intended to politicize this case, inflame media coverage and taint the jury pool.”
Assistant U.S. Attorney Andrew DeFilippis, a member of Durham’s team, said prosecutors wanted “a crystal clear factual record” for the whole case.
He said: “We don’t want to get into that game. We’re being very careful.
“We think everything we said in the motion was accurate.
“I’d be hesitant to call out misinterpretations or misstatements that may be out there,” he said.

Michael Sussmann should give up a bigger fish.
The Obama led puppeteers of Geriatric Joe Biden are going to deep six Hillary so far that she will be drinking her own pish instead of the elixirs of the American MArxist gods.
Hillary is throwing her considerable weight around and Obama wants that to stop, making sure she is “retired.”
Otherwise Durham would not be prosecuting this case.

I think Durham went out of his way to rattle the conspirators. AKA “shaking the tree to see what falls out”
“Good, now Durham needs to start ramping things up. He’s been at this since 2017. The scumbags that were involved in this scam are also the ones making a mess of the world right now.”
At this point I’m cool with it wrapping up September 2024.
Attorneys get to decide what facts are relevant; not the judge. Far better to put too much in a response to a motion than too little.
Durham may have included way more facts to win the motion as a warning to Sussman’s lawyers to stop giving bullshit motions. They did not help their client.
