Meet Donald Trump, the constitutional scholar.
The twice-impeached former president is claiming that the bipartisan effort to reform the Electoral Count Act of 1887 proves that ex-Vice President Mike Pence had the legal right to overturn the results of the 2020 election that Trump lost.
“If the Vice President (Mike Pence) had “absolutely no right” to change the Presidential Election results in the Senate ... how come the Democrats and RINO Republicans are desperately trying to pass legislation that will not allow the Vice President to change the results of the election?” Trump asked.
Without providing any facts or legal precedent, Trump suggested the effort to clarify the 135-year-old statute means Pence would have been within his rights to reject the results of the electoral votes cast by the states on Jan. 6, 2021.

Rejecting results and refusing to certify them was absolutely within Pence’s authority when he certified the Electoral Votes.
But that does not OVERTURN the election, it puts it under a higher level of scrutiny in order to be certified.
Just another rant from a dedicated never Trumper.
He did.
Note that both the Democrats and Republicans are looking into writing a law to disallow that going forward.
If they need a law… it was legal.
(And, in fact, was attempted by Democrats in 2016 and 2004…. But don’t let the propaganda convince ya!)
He had no such authority. And his job was to read them into the record...nothing more.
He had the power to question some of the certifications. That is far different than overturning.
If, without Pence, the election could NOT have been certified, Trump’s assertion is true. How is it not?
There was an ad campaign in 2016 begging electors to change their votes.
No, it was not. That is complete fiction. The office of Vice President has absolutely no such powers, authority, or role under the Constitution nor statute. Other than ruling on parliamentary procedures preceding over the session, he no powers or role other than to see to it they are counted. He "shall" count them. Very clear.

Absolutely disagree. The position of "President of the Senate" has discretion, or it would not have been identified as necessary for the process.
The rules for interpreting Constitutional law require that the clauses of the constitution cannot be interpreted as having no effect.
Saying the President of the Senate is a rubber stamp, renders that clause as having no effect.

Trump needs to quit listening to whoever is feeding him this garbage. The Vice President has no such power, role, or authority. Never has. Even if theoretically the Vice President could do such a thing on his/her own motion, a member at the joint session could simply say “I appeal the ruling of the chair” and it would be voted down and that would be the end of that rather quickly.
Trump has been correct about almost everything. The media called him a liar, but history has proven him correct on the majority of the calls. Covid=Wuhan lab. HCQ and Ivermectin=trials demonstrate effective. Biden and Putin. Biden and the gas pipelines. Biden and mandates. BLM at the Democrats. Government traitors. Election manipulations. How to fix the economy. New trade deals. Biden a crook, and in on with his son. Biden and China. Pedophile problems. The drug trade and borders. The sex trade and borders. The plot to destroy him with fake dossier. The plot to show that he shuffled illegal money. The plot to say he did illegal tax stuff....

Truth is, Trump was a mean tweeter. He also managed to pick some traitors people to work for him....and that is a character problem that I fear the most if he ever takes office again.
There was no legitimate election to overturn.
He has discretionary power or the Constitution would not have specified that office. To treat the “president of the Senate” as rubber stamp renders that clause of the constitution as having no effect.
The Constitution does indeed clearly define the role and powers and does not grant the Vice President any such authority.
Where was that authority given him?
“He “shall” count them. Very clear.”
“Shall not be infringed” is also in that old and yellowed rag.
But they seem to avoid that all the time.
If it required an action, then it also allowed for an in-action. If Zero Future Mike didn’t, then something else could have occured.
