Fox News host Tucker Carlson on Thursday evening called Supreme Court Justice Brett Kavanaugh a “cringing little liberal” after Kavanaugh sided with the liberal justices to uphold a health care vaccine mandate.
As highlighted by the Washington Examiner, Trump-appointed Kavanaugh and Chief Justice John Roberts joined the three liberal justices on the court to allow a vaccine mandate for medical facilities that take Medicare or Medicaid payments.
Speaking about the ruling with attorney Harmeet Dhillon, who represented The Daily Wire in the fight against the Biden administration, Carlson chimed in, “With no help from Brett Kavanaugh, I notice. Cringing little liberal.”

In my forthcoming book, “Dragonslayers” (out March 15), “Six Presidents and their War with the Swamp,” in my Reagan chapter I go into how the courts over the last 40 years have basically ceded authority to the agencies to define their own powers.
It’s completely wrong, but any jurist growing up with that “law” would have a tough time fighting off that tradition. It takes a Thomas or a Scalia.

If it’s unconstitutional for private employers, how can it be “constitutional” if you work in healthcare.
The homeless are not dying because they are all skinny from drugs and they are very healthy with no comorbidities because people that are homeless with say diabetes or other health issues die off quickly.

I thought that was the point of the SCOTUS ruling. The CMS legislation gave enough authority to CMS to be able to require the mandate for health workers.
The OSHA legislation did not.
Don't know the specifics of what regulations they specifically relied on. But I bet the SCOTUS ruling explains it or at least references it.
Everybody except triple masked shut ins are going to get the Chicom flu. This latest variant spreads like crazy. Most people are not even bothering to be tested because symptoms are so light in most.

My ire re the SCOTUS hearings on this is that they discussed and considered the effectiveness of, or lack thereof, the treatments. They don’t need to know ONE SINGLE THING about efficacy. They only need to know the Constitution and what it says about liberty. That is IT!!
A ridiculous, spirit killing ruling. Roberts and Kavanaugh should do the country a good turn and jump off the nearest cliff.
How to understand mandating HCWs to “vaccinate” will prevent Covid from spreading, or protect others when the vaccinated are unprotected?
There is no understanding, here, unless it’s all about complete government takeover of healthcare.
Imagine “Medicare for all” with a government bureaucracy like CMS in control.

Isn’t the healthcare ruling, tied to recipients that benefit from the acceptance of federal money, really the same deal that’s going on with churches and the tax exempt benefit that they receive? How is it different?
If you are ok with taking the fed money/benefit, then you must play by all the rules that the fed sets - and you understand this before you step into this agreement.
Perhaps this is Kavanaughs’ angle. A possible silver lining, this ruling could result in more entities rethinking their plans to partner with the government in the future.
