Last week, the Occupational Safety and Health Administration (OSHA) sent its emergency temporary standard (ETS) to the White House regarding COVID-19 testing and vaccine mandates for business with 100 employees or more. While we still await the final ruling from the Biden administration, SHRM reported some of potential implications that BSCs, distributors, in-house staff and other players in the cleaning industry could be facing.
Testing Standards..
Employees could be required to either get vaccinated or undergo weekly testing to keep employment.
Time-Off..
Employers under the standard may have to allow their employees paid time off, both to receive the vaccination at sites as well as additional time in the case of any potential systems stemming from the dose.
Penalties..
Businesses that fail to meet the requirements could be liable for a $14,000 fine for each proven instance of a violation.
Timetable..
There is no definitive expected date on an announcement. Some ETS processes can take up to months, but considering the critical nature of COVID-19, it could be expedited to any day. When implemented, the ruling would impact over 80 million American employees.
What could possibly go wrong?
Since vaccine mandates are not in the Constitution, what LAW authorizes the government to mandate specific medical treatment?
The answer is none.
It is not in the enumerated powers of Congress, thus it Constitutionally falls to the States to set vaccine requirements.
And what happens when the vast majority of Servicers(independent contractors) for these businesses REFUSE to work for them because of the mandate???
I will not comply. Period.

OSHA regulates physical safety measures. I don’t believe this falls under their umbrella and the courts will through it out.

Seriously don’t want to lose my job. But being in the 50 and younger crowd and the news over the last few weeks and months regarding the vaccines, there is no way in the world I am going to take one of the jabs. I have worked from home for about a decade for goodness sakes.

Ahhh yes, except FDR started it broadly and the Supreme Court helped implement by ignoring your correct interpretation of the US Constitution as one limited to its enumerated powers. The judiciary found utility in the Commerce Clause to destroy state and individual rights and implement all sorts of leftist programs .... there is precedence that the states “gave up” their power in matters of workplace safety.
As long as a state can meet fed OSHA’s requirements, states may run their own program, provided the state’s workplace plan is reviewed and approved by OSHA. There are some states where workplace safety is overseen entirely by federal DOL/OSHA.

To conclude my explanation in “15” herein above which answers your question, if fed-OSHA mandates the rule, under existing law any state that enforces workplace safety must implement as part of its state plan.
There are several legal avenues to attack OSHA’s mandate, including that it is not factually supported to show that the workplace is so dangerous unless all employees are vaxxed. Don’t expect employers to fight it; it will be either unions or individual workers. They are up against the machine, and we have seen, unless it is Trump in the WH, the givernment almost always wins.
Biden, installed occupant of the White House, cannot delegate a constitutionally unfounded power to a Executive Branch Department that he himself does not have. The Supreje Court will quickly quash this. It’s a big bluff built on the backs of businesses desperate to keep it acquire help.
Cruel and unusual punishment
