Days before the start of a tumultuous term, and after the Supreme Court justices divided bitterly over a Texas law that bars most abortions after six weeks, Justice Sonia Sotomayor warned an audience of law students about the frustration of having to write dissents.
"There is going to be a lot of disappointment in the law, a huge amount," she said Wednesday at an event hosted by the American Bar Association. "Look at me, look at my dissents."....
"The Court's order is stunning," Sotomayor wrote at the time. "Presented with an application to join a flagrantly unconstitutional law engineered to prohibit women from exercising their constitutional rights and evade judicial scrutiny, a majority of the Justices have opted to bury their heads in the sand."
Sotomayor added: "The Court should not be so content to ignore its constitutional obligations to protect not only the rights of women, but also the sanctity of its precedents and of the rule of law," she concluded.

IMHO using case law is what chips away at the Constitution. The foremost point of every SCOTUS opinion needs to cite the Constitution.

Nowhere does this “Wise Latina” (implying that there are many unwise Latinas) ever discuss the question of “when does life begin?”
The most frequent argument is about women impregnated by rape.
This is such an easy one to debunk....first, pregnancy by rape is miniscule. Second, there is Plan B available over the counter. But even then, that unfortunate raped woman has 6 weeks to take action before any restrictions set in.
With crisis centers and hospitals fully organized to support women who have been raped, there is no excuse for a raped woman to wait more than 6 weeks to terminate the product of a crime.
I agree 100%. Case law can perpetuate bad as well as good decisions - AND can reflect the political biases of the decision makers at the time. It's interesting that the same people who want the Constitution to be thought of as a 'living and changeable document' also want case law to stand as gospel.
IMHO the legal system in the US is way more broken than the medical system has ever been.
