Active Duty, Retired Naval Intelligence Members Told They Cannot ‘Disrespect’ Biden Over Afghanistan Debacle

Top leadership at the Office of Naval Intelligence (ONI) informed active duty and retired service members that they cannot condemn President Joe Biden amid the chaotic — and now deadly — pullout of American troops from Afghanistan. 

In an email from the ONI’s Chief of Staff, ONI members were reminded that per a Uniform Code of Military Justice and Department of Defense Directive clause they cannot disrespect senior government leadership. This includes the President, Vice President, Congress, the Secretary of Defense, and more. 

 
 

The email reads: 

Given the heightened political and social atmosphere surrounding Afghanistan, it is important to remind our uniformed personnel (active duty and reservists on temporary active duty) and military retirees of their responsibilities and obligations under Article 88 of the Uniform Code of Military Justice and Department of Defense Directive 1344.10. While it is vital to protect the constitutional right of freedom of expression for these groups, consistent with mission accomplishment, national security, and good order and discipline, it’s important to remember certain limitations. Namely, uniformed personnel and military retirees are prohibited from disrespecting senior government leadership (e.g. the President, Vice President, Congress, Secretary of Defense, Service Secretaries, etc.).

Per the same uniformed personnel policy, ONI members cannot participate in partisan political activity or distribute partisan political literature. An internal ONI member told The Daily Wire that these policies were more relaxed under the Trump administration and recalled retired officers condemning the former President.

Exactly what happened in Benghazi, when Hillary purposely left our men to be massacred. Nearby military troops who wanted to rescue them were told to stand down. Dress rehearsal for current events.

That word. That word. Disrespect really is a word, according to the OED. it’s been around since the 1600’s. It’s not a nouveau word originating in the ghetto. Not all grammarians like it though.

” The trend I’m seeing is that poor grammar habits are not only perpetuated into adulthood, but can be treated as an accepted form of speech used on TV or the radio. I suspect that eventually it is accepted as proper grammar . . . The most notable example is the current vernacular use of “disrespect” as a verb, as in “he disrespected me”. Sounds like nails on a blackboard to me, however, it’s all over the media.

“government contended that Fleet Marine Corps Reservists’ receipt of retainer pay and the ability of the Secretary of the Navy to recall them to active duty at any time necessitated jurisdiction”

Using this the Government could require all Military Retiree active reserve members to be injected with the Covid vaccine.

If a retiree still falls under the UMCJ they can still be given direct orders.

Article 88 does not refer to enlisted men/women, active or retired. It does apply to active duty commissioned officers.

Civilians are definitely not covered under the UCMJ. Recalling a retired member of the military to active duty is not an easy task and is covered under regulations that require specific reasons for the recall.

I have never seen a retiree recalled other than when their specialty was badly undermanned or the retiree had a critical skill and had not voluntarily agreed to return to active duty.

Below is Article 88 and commentary from an article about it.

“When a military member is wearing the uniform and receiving a salary from the Department of Defense, that military member has essentially signed away his First Amendment rights granted by the Constitution.

The exact words of the Uniform Code of Military Justice Article 88 - Contempt Toward Public Officials states: “Any commissioned officer who uses contemptuous words against the President, the Vice President, Congress, the Secretary of Defense, the Secretary of a military department, the Secretary of Transportation, or the Governor or legislature of any State, Territory, Commonwealth, or possession in which he is on duty or present shall be punished as a court-martial may direct.”

The main reason for this regulation is to keep military members who have access to major weapons of war to ever get involved in politics. Once they are retired or resigned their commission and a civilian citizen, they may partake in such political arguments in both written or spoken word. With the advent of social media it can be a slippery slope for military members to discuss such matters and could even be subject to UCMJ violations. That is why you will find military members refrain from that activity or have incognito social media accounts.

What Determines Contempt Toward Officials

(1) That the accused was a commissioned officer of the United States armed forces;

(2) That the accused used certain words against an official or legislature named in the article;

(3) That by an act of the accused these words came to the knowledge of a person other than the accused; and

(4) That the words used were contemptuous, either in themselves or by virtue of the circumstances under which they were used. Note: If the words were against a Governor or legislature, add the following element

(5) That the accused was then present in the State, Territory, Commonwealth, or possession of the Governor or legislature concerned.”

I am not ex-military and I am prepared to criticize both the Prime Mistake of my country, True-dope, AND the unelected (or at least, not legally elected) President of the US, XiJinBiden. Unfortunately, True-dope is trying to bring in legislation that prohibits criticism of politicians on the grounds that it is discriminatory. He can KMHA.

I am not ex-military because when I was of age, Pierre Trudeau (aka Rocky Waterhole) was PM of Canada. I figured that if a war started between the Soviets and NATO, Trudeau would side with the communists and attack the US. As I have relatives in the US, some having served in the US military at that time, I was certainly NOT willing to fire on Americans. I was also not prepared to side with the communists, so I chose not to join the CAF.

Gosh that’s odd....because nobody seems to have told retired generals they weren’t allowed to say all kinds of slanders and other garbage about Trump or risk losing their pensions and security clearances under the UCMJ.

So how come NOW they aren’t allowed to criticize the POTATUS?
