The U.S. military is warning both active duty and retired service members that no “disrespect” of President Biden will be tolerated.
The Office of Naval Intelligence’s Chief of Staff recently emailed service members to remind them of the Uniform Code of Military Justice. The UCMJ prohibits the public questioning of the President, the Vice President, Congress, or the Secretary of Defense, among others. The email was obtained by the Daily Wire on Friday. It reads as follows:
Given the heightened political and social atmosphere surrounding Afghanistan, it is important to remind our uniformed personnel (active duty and reservists on temporary active duty) and military retirees of their responsibilities and obligations under Article 88 of the Uniform Code of Military Justice and Department of Defense Directive 1344.10. While it is vital to protect the constitutional right of freedom of expression for these groups, consistent with mission accomplishment, national security, and good order and discipline, it’s important to remember certain limitations. Namely, uniformed personnel and military retirees are prohibited from disrespecting senior government leadership (e.g. the President, Vice President, Congress, Secretary of Defense, Service Secretaries, etc.).

There are quite a few of them that are quite smart. But they are enthralled with the power they currently have and are willing to take some arrows to maintain that power. Bad results down the road will be someone else’s problem - the ends justify the means.

They can be recalled to active duty for punishment under the UCMJ. I agree, it would be a real chickens#@t move to do it for political reasons. But look at the caliber of leadership, no surprise here.

they can be critical of activities but not individuals/disparaging characters, penalties up to courts marshal, reduction of retired pay etc. they haven’t used it much, no one this bad, untested waters like sedition act
They’re a bit too late. Almost everyone where I work has already engaged in such behavior. Of course, we’re due to get “lectured” on Monday by the Base Commander but most everyone will turn a deaf ear to him.
I am retired and am not an expert but I have read that they would have to recall us to Active Duty and then Courts Marshall us.
Someone may have already said this... but wasn’t just a few years ago that dissent was considered the very hight of displaying patriotism? What’s that you are saying Pelosi / Clinton?????

You have that option. DoD has the option to recall you to active duty, court martial you, and “dismiss” you from service. That means you’re dismissed and no longer retired, and you won’t draw retired pay.
The disrespect of Biden is ubiquitous. Disrespect from within the military will be the least of their concerns.

42 U.S. Code § 212 - Retirement of commissioned officers
(c)Recall to active duty
A commissioned officer, retired for reasons other than for failure of promotion to the senior grade, may (1) if an officer of the Regular Corps entitled to retired pay under subsection (a) or under section 213a(a)(19) of this title, be involuntarily recalled to active duty during such times as the Commissioned Corps constitutes a branch of the land or naval forces of the United States, and (2) if an officer of either the Regular Corps or Ready Reserve Corps, be recalled to active duty at any time with his consent.
We had a mustang O-5 retire (30 years) when accused of conduct unbecoming an officer (an affair with an E-4s wife). The investigation revealed enough concern that sexual assault and rape charges were preferred. He was recalled to stand a general courts martial and was found guilty of conduct unbecoming only. He was demoted to O-3 then he retired at the lower grade.
I think with his 30 years in he was not in the ready reserve. It was messy all the way around and the Air Division commander wanted to nail him because of the negative public image it presented.
