Supreme Court Chief Justice John Roberts will not preside over former President Trump’s Senate impeachment trial, which is scheduled to begin in earnest on Feb. 8.
Instead, Senate President Pro Tempore Patrick Leahy (Vt.), the most senior member of the Senate Democratic Conference, will preside over the trial.
Leahy on Monday confirmed he would wield the gavel and promised to administer “impartial justice.”
Republicans say Roberts’s absence undermines the legitimacy of the trial.
“The Constitution requires that the chief justice preside over the impeachment trial of a president but that’s not what we’re doing. To me that’s indicative of the fact that we’re in uncharted waters,” said Sen. John Cornyn (R-Texas), a member of the Judiciary Committee.
“I just think it looks very petty and vindictive and I understand there are a lot of people who are mad but the process itself already looks like a railroad job,” he added.
Cornyn said having a Democrat preside over the trial “really undermines the legitimacy.”
Other GOP senators echoed that criticism.
“If the chief justice doesn’t preside, I think it’s an illegitimate hearing and really goes to show that it’s not really constitutional to impeach someone who’s not president,” said Sen. Rand Paul (R-Ky.).
Leahy on Monday pushed back on the Republican criticism.
“I have presided over hundreds of hours in my time in the Senate. I don’t think anybody has ever suggested I was anything but impartial in those hundreds of hours,” he said.

The Democrat Party is making more and more of a mockery of what used to be the Constitution. Very few care. More and they are saying to hades with the Constitution. Very few care. And in their defense. why should they? The Country has been dumbed down by the education system that no one knows what the Constitution was. We are no longer going to hell in a handbasket. We have arrived.
This is so much a sham even Roberts won’t participate. That is saying a lot.

The Senate shall have the sole Power to try all Impeachments.
When sitting for that Purpose, they shall be on Oath or Affirmation.
When the President of the United States is tried, the Chief Justice
SHALL preside: And no Person shall be convicted without the
Concurrence of two thirds of the Members present.
"SHALL" means he must preside over an Impeachment Trial.
Shall is ironclad. It's not the same as may, or might.
Romney, Collins, and Murkowski - the usual RINOs.
Plus retiring Senators Toomey, Portman, and Burr (maybe).
Pretty good odds that McConnell will vote to convict.
If they hold a secret vote (no names), then it’s likely even more GOP senators will vote with the Dems.

There is nothing Constitutional going on at all.
If the Congress critters have so much free time on their hands that they can spend it harassing President Trump and inventing “charges” on which to harass him, then they should call recess. Obviously, they are wasting our taxpayer dollars by staying in DC when they have no real work to do. They apparently have not had any real work since at least 2016.
Their behavior highlights the truth of the old adage, “Idle hands are the devil’s workshop.”

We’ve truly stepped through the looking glass into Wonderland now that Red Queen of Hearts Leahy will declare “Sentence first, trial after! Off with his head!” and go onto the Mall Ellipse to play political croquet with Flamingo mallets, while his fellow Democrats start their Caucus Race, running in Circles chasing Qs and finding imaginary conservatives painting white roses red, but not blue!
I would as Sasse to that list of traitors.
