Let's get real Pence could not give the Presidency to Trump

Posted on 01/12/2021 7:30:24 PM PST by springwater13

A couple things would have happened if Pence unilaterally ignored the election results in the Senate.

1) The Democrats would immediately sue and it would go before the Supreme Court within 24 hours and overturned. Even a Republican Majority could not allow it as it would create the Precedent of any future Democrat Vice President being given the authority to unilaterally void an electoral college and Congressional certification vote. It was always a ludicrous argument.

2) Pence would be promptly impeached by Pelosi and likely would have to resign or face a Senate trial.

The only thing it may have done was stop the riot and insurrection and make Pence a folk hero to millions and likely 2024 front runner in the primary. It wouldn't have given Trump a second term though.

I am split on this because of the issues you raised. In the Constitution there is nothing stating that Pence had this power and the Constitution is supposed to be a document that LIMITS the power of Government of which Pence is part of.

On the other hand to certify Electors that were questionable is not faithfully following the Constitution affirmed by OATH whereas:

No one was asking Pence to reverse anything. All that was being asked of Pence was to delay counting the votes due to the fact that State Legislatures from PA and AZ were asking for time to review what happened in their states, and reportedly GA and WI legislatures wanted the same. The Governors of those states were refusing to let the State Legislatures call a special session so they had to wait until regular session.

There is absolutely nothing in the Constitution saying the Electoral Votes must be counted on January 6th.

According to President Trump’s attorney John Eastman, Pence grossly exaggerated and mis-characterized what they were asking him to do.

You are setting up a straw man fallacy.

The request of Pence wasn't for him to "unilaterally ignore the election results".

Four state legislatures sent letters to Pence saying that they were taking back their constitutional right to send the electors.

And they requested five to ten days to investigate and then send the electors.

Pence should have accepted that request. It would have been the correct constitutional thing to do. But Pence didn't do that.

As I understood it, some or all of the contested States Legislative branches failed to send their alternate electors to the House for consideration. I personally believe it was all smoke and mirrors.

Every GOP POS is running for some type of cover right now. Including State GOP asshats who lacked the testicular fortitude to do anything in the first place. The GOP needs people to believe they were on Trumps side therefore they were on our side. Are we really still that stupid? Or do they just think we are? The RINOS like Cheney who are safe for reelection could care less, but because of her and the other RINOS who turned on we the people, the GOP will never see another dime from me.

FNC THE GOP!

So are we just acknowledging at this point that there is absolutely zero chance of institutional power ever being used in our favor?

If so, are we going to do something constructive or just belly-ache?

BS...

All Pence had to do is call for a special, 10 day vote delay, to form a commission to investigate voter despute and to report back the findings.

This would have been the right thing to do and there is precedence for it in the 1877 POTUS election Electoral dispute between candidates Tilden - Hayes.

n 1876, when the nation went to the polls to elect Grant’s successor, Democratic candidate Samuel Tilden, governor of New York, emerged with a lead of more than 260,000 popular votes. But Tilden had amassed only 184 electoral votes—one shy of the number needed to defeat his Republican opponent, Governor Rutherford B. Hayes of Ohio. Returns from three states (Louisiana, Florida, South Carolina) were in dispute, with both sides claiming victory. Together, the states represented a total of 19 electoral votes, which along with one disputed elector from Oregon would be enough to swing the election Hayes’s way.

The U.S. Constitution provided no way of resolving the dispute, and now Congress would have to decide. As Democrats controlled the House of Representatives, and Republicans dominated in the Senate, the two sides compromised by creating a bipartisan electoral commission with five representatives, five senators and five Supreme Court justices.

Though the commission was supposed to be comprised of seven Republicans, seven Democrats and one independent, the independent—Supreme Court Justice David Davis—ended up dropping out when he was offered a Senate seat, and a Republican was named to replace him. In the end, after a series of votes along strict party lines, the commission awarded Hayes all three of the contested states in early March 1877, making him the winner by a single electoral vote.

At the very least Trump exposed the cowards.

We must vote out every single Republican incumbent the next time they are up for election, every one of them is tainted.

He wouldn’t take Trump’s calls and didn’t consult him on the Lawsuits he filed.

Do you think Tim Kaine would do this to Hillary?

Think Biden would do it to Obama?

Please.

Almost everyone turned on Trump, and we now most prefer the Republicans that are designed and planned to fall and kneel before the Democrats, like John McCain.

Let’s get real. Pence was AWOL for two months after the election. He used none of his mainline GOP gravitas to apply pressure to other national and state Republicans to support their fellow Republicans who were victims of Democrat voter fraud.

The steal certification issue is a red herring. It’s what the GOP did or more importantly did not do before AND after the election. The GOP aided and abetted the steal at every stage. That makes the steal a fully bipartisan get Trump operation.

Reason? Thanks for bringing SENSE to the site.

The guy actually misrepresented the request of Pence from the Trump team.

Anybody can set up a straw man fallacy and then knock it down, and that's what the poster did.

I wouldn't call that "SENSE".

But you would.

” It was always a ludicrous argument. “

Ludicrous is an understatement.

But the Qtards believed it anyway.

Which is prima facie proof they’ll believe anything.

He is a conservative, like me.

The real problem was Trump’s lawyers wasted so much time “building their case” when the trial was being played out in the court of public opinion.

I hope they didn't spend much time on the court cases given their record.

Their PR campaign was much, much more effective.
