Supreme Court Justice Elena Kagan denied a request from Republicans to stop Montana Gov. Steve Bullock’s (D) plan to mail ballots to all registered voters.
Kagan, who has jurisdiction over the case based on geography, denied the request without referring the case to the full court.
The suit was brought by Joe Lamm of the Ravali County Republican Central Committee and other voters.
The GOP-dominated Legislature banned mail-in ballots for general elections, instead allowing only by-request, no-excuse-required “absentee ballots” and in-person voting compatible with Phase 2 safety restrictions in the governor’s COVID-19 reopening plan.
But Bullock argued an emergency declaration connected to the coronavirus pandemic allows him to suspend that state law.

Of course, she knew it was likely the full court would probably have stopped the Montana rats from braking their own election laws. Buy hey there are no Obama Judges right John? The idea that Montana is so crippled by the virus that they need to toss election law is just insulting. You can bet the they are loading up the mail trucks right now so if there is a full court ruling it will come too late.
This may be the case that triggers a full SCOTUS decision. Kagan has set it up for a complete court decision. Keep an eye on the case. You may want to alert the troops.

This is just more evidence that the COVID health emergencies have given governors far too much arbitrary power.

Her ruling set it up for the entire court to hear. It only takes one ruling by all and ALL mailing of ballots will be ruled unconstitutional. Pray for that ruling. It WILL be made before the election. Emergency case! I’ve been expecting a case to emerge for a couple of weeks. This appears to be THE one Other states may join.

My friend received a ballot, AND one for her husband. He’s been dead about 12 years.
There has to be a case heard in front of the entire SCOTUS to bring law and order to the entire nation. In order for that to occur judges must rule in negative ways so the case can be appealed to move it through the system to that level. Both the premise of the case and the defendant and those filing suit must be valid. Kagan has actually done the next step to achieve its ultimate goal. Full court hearing.
The governors have taken on more power than their office allows. It only can be rectified in the judicial system. It appears to be on its way.
