Minnesota Second Congressional District race delayed after death of Legal Marijuana Now candidate

The Legal Marijuana Now Party’s candidate in the race for the Second Congressional District has died, prompting a special election in February.

Adam Charles Weeks died earlier this week, said Kevin O’Connor, the party’s candidate for U.S. Senate. “It’s a sad and sudden thing. We are pretty much taken aback,” he said.

Weeks was facing off with Democratic U.S. Rep. Angie Craig and Republican candidate Tyler Kistner to represent the district. That election will now be postponed.

“The law is clear on what happens next,” Secretary of State Steve Simon said in a statement Thursday. “If a major party nominee dies within 79 days of Election Day; a special election will be held for that office on the second Tuesday of February (February 9, 2021).”

In 2013, the Minnesota Legislature changed the state election law to delay elections rather than repeating the rushed outcome that followed the death of Sen. Paul Wellstone.

As if 2020 couldn't get just a bit weirder, it has.

I live in the 2nd District. It is a GOP leaning district but not heavily so. Until 2018, it was in GOP hands for about 15 years.

Per the article, the race for Congress has now been postponed 'til early next year.

Incumbent Dem Rep Angie Craig will vacate this seat on January 3rd and it will remain vacant until the winner of the special election takes the seat.

Comments or opinions - anyone?

Why are they postponing? If the Weed candidate wins, they just pick someone to take their place.

Legal Weed Party is not a major political party.

Agreed. Senator Paul Wellstone died 11 days before the election. The Dems replaced him on the ballot with Walter Mondale. Jesse Ventura appointed someone to finish Wellstone's term, and Republican Norm Coleman was elected to that seat, then had the seat stolen from him by Al Franken by 312 votes.

I think honk it helps the republicans to have the 3 on the ballot. Why go to court?

I’m guessing it wasn’t weed that killed him.
Probably heroin or pills, maybe alcohol.

Who gets to define "major party"?

According to the article, the "Grassroots-Legalize Cannabis" party also is a major party there. Are they for smoking the other end of the weed?

The republican probably was winning.
Do you think they would postpone the election until February if the democrat was winning?
Plus, it’s not a major party, and they can’t just postpone an election, when the federal law says the election must take place the first Tuesday in November.

https://en.wikipedia.org/wiki/List_of_political_parties_in_Minnesota#Recognition

Qualifying as a recognized major or minor political party is determined by how many candidates a party nominates for certain partisan offices, how well candidates for statewide office do in certain partisan elections, or a petition that has the required number of signatures. Generally, a party that presents a statewide candidate that receives at least five percent of the vote or presents a petition to the secretary of state containing a number of signatures equal to at least five percent of the number of individuals who voted in the preceding general election qualifies as a recognized major party. Similarly, the threshold is one percent to qualify as a recognized minor party.

Parties recognized as a major or minor party are eligible to receive funds from the state elections campaign account. Recognized major parties also have automatic ballot access.[2]

I wonder if the “pot” party is on the ballot in all fifty states.

I looked it up. The druggie got 5 percent which is eligible for being on the ballot. Then state law says if a person dies within 79 days of the election, the new election is held the second Tuesday of February.

Does that matter? I mean, if this seat is for the federal government, wouldn’t it have to be on the ballot nationwide? Whereas if it’s a state seat, then it would only have to be on the state ballot, right?

Sorry for my ignorance on this issue.
