As President Trump moves to nominate a candidate to fill the seat of Justice Ruth Bader Ginsburg, who died Friday, there are a growing number of Democrats threatening to implement a radical strategy and pack the Supreme Court if they take control of the White House and the Senate.
If he holds a vote in 2020, we pack the court in 2021, Rep. Joe Kennedy III, D-Mass., tweeted on Saturday. Its that simple.
Mitch McConnell set the precedent. No Supreme Court vacancies filled in an election year. If he violates it, when Democrats control the Senate in the next Congress, we must abolish the filibuster and expand the Supreme Court, Sen. Ed Markey, D-Mass., tweeted.
The idea of packing the court with extra justices -- attempted unsuccessfully by President Franklin Delano Roosevelt in 1937 to force through parts of his New Deal that were ruled unconstitutional by the high court -- has bubbled away on the fringes of the party for years.

I agree. But what are the chances that the 1869 Judiciary Act would be repealed with a new one? And would the existing Supreme Court have the authority to prevent that from happening?
I had no idea they could expand the court.
I agree though, either party that does that in order to gain the majority is going to be met with a lot of criticism. We can get a majority by Trump appointing someone now.

If the Democrats get the Senate, the House and the Presidency, and are willing to nuke the filibuster (which they have already said the will do), they can change it with a simple majority vote in both Houses. I can’t think of any grounds for SCOTUS to prevent it.

One way it could be done would be if the court declares the replacement of the Judiciary Act as unconstitutional say, because it considers packing the court would put too much of a burden on its duties under Article III of the Constitution. Who'd be in a position to say otherwise? After all, the law against abortion was declared unconstitutional on privacy grounds, even though the Constitution says nothing about privacy,

And Fieldmarshaldj made a great point about widdle Joe Kennedy III threatening that "we" will pack the court as "payback" against Trump in 2021, apparently forgetting he will be unemployed in Jan. 2021 since he gave up his congressional seat in his failed bid for the U.S. Senate.
The RATS latest empty threats are on the level of the Einstein's on "our side" who said they would impeach and remove Roberts in 2012 over his Obamacare vote. Yeah, I'm sure President Obama would have named someone soooo much better to fill that seat afterwards!

Perhaps. But we also have RBG's own words, "Nine seems to be a good number, and it's been that way for a long time. [Packing the court], if anything, would make the court appear partisan."
Which would make the court's duties, as stipulated in the Constitution, almost impossible, because nobody would be able to trust that any decision it makes is fair.
