As President Trump moves to nominate a candidate to fill the seat of Justice Ruth Bader Ginsburg, who died Friday, there are a growing number of Democrats threatening to implement a radical strategy and pack the Supreme Court if they take control of the White House and the Senate.
“If he holds a vote in 2020, we pack the court in 2021,” Rep. Joe Kennedy III, D-Mass., tweeted on Saturday. “It’s that simple.”
“Mitch McConnell set the precedent. No Supreme Court vacancies filled in an election year. If he violates it, when Democrats control the Senate in the next Congress, we must abolish the filibuster and expand the Supreme Court,” Sen. Ed Markey, D-Mass., tweeted.
The idea of “packing” the court with extra justices -- attempted unsuccessfully by President Franklin Delano Roosevelt in 1937 to force through parts of his New Deal that were ruled unconstitutional by the high court -- has bubbled away on the fringes of the party for years.

How is that different from what they are doing now?
They had already pretty much pledged to do this long ago because it was unacceptable that the Senate has been confirming the nominees of President Trump.
So they are “threatening” to do something they had already pledged to do, regardless of this current vacancy.
Time to play hardball. These are not good people. It would be nice to have the bipartisan rappart that may have existed at one time on this, but the Left put that in the rear-view window long ago. there is no longer any goodwill on the Dem side - and it is time we realized that and started acting like it.

Packing the court could backfire in the long run, because it dilutes the power of each vote. We won’t have any more 5-4 decisions; they will have to be 6-5 or 7-6.

I think it’s a great idea. A court with this kind of power should have 100m members (i.e. active voters). Ultimately, serious issues that are politically-sensitive should be decided by referendum (i.e. voters). For one thing, we’d immediately see the reinstatement of the death penalty for murder in cases where minors are above the age of 12.
Exactly! If the Demon-crats gain both Houses of Congress and the White House, their wish list will be enacted ASAP; Green New Deal, tax hikes, Medicare For All, DC and PR statehood, all of it.
