The victim and his girlfriend told detectives they were walking west on 40th Street West when they noticed two men who appeared to be following them.
They allegedly stopped at one point to allow the men to pass, but the suspects also stopped.
He said the suspect grabbed him by the throat and said, This is how its gonna go down, sheriffs spokesman Ed Troyer said.
The victim told deputies he was afraid for his life and shot the other man once or twice.

Good job. Probably shot himself in the leg during the scuffle. I know what I would have done, but won’t post it here.
In a deadly threat situation, one must continue to fire until the threat is neutralized. The perp might have a gun holstered on his ankle and pull it and kill you after you merely wound him. Can’t be too careful. Literally. Fully neutralize the threat.
That’s what I’ve read and heard. Any contrary legal opinions out there?

I think that’s BS. It may be easier for you legally (but not perfect), but practically, it’s not always true someone will kill you regardless. Assess the situation yourself.

Bill Allard confronted an armed robber in a market and shouted the command, Police! Drop your weapon! The gunman swung on Allard, who shot the gunman in the chest with a blast of 00 buckshot from his 14-inch-barreled Ithaca Model 37 12 gauge shotgun. The man jerked back away from him, still wielding the gun, and Allard pumped another blast of 00 buckshot through his thorax. The gunman was still up and running. Allards partner (an officer other than Cirillo that day) then deliberately shot the suspect in the butt with his .38 Special revolver to break his pelvis and bring him down. The .38 did exactly that, and the suspect sprawled on his face, dropping his .32 semi-auto.
Allard lowered his shotgun to a low-ready position and slowly moved in on the downed man. Suddenly, the gunman snatched up the dropped pistol and tried to roll over and bring it to bear to kill Allard, who simply pulled his own trigger and hammered a third round of buckshot into the mans chest. The suspect dropped the gun for the last time, and the fight was over.

It’s what the Israeli IDF does. They use modified Ruger 10-22’s for urban sniper defense and that’s exactly what they do; either to the knees or right in the crotch.

...... unless hit in an immediately vital area, death is not always instantaneous. Unlike movie portrayals where people die instantly. There is still a lot of life in some animals, and they can take a long time to give up the ghost.
