A woman born in New Jersey, who fled the United States to join the Islamic State five years ago, isn't an American citizen and won't be leaving the Syrian refugee camp where she resides, a federal judge ruled.
Hoda Muthana, the so-called ISIS bride, doesnt have a constitutional right to return to the United States because she is not a U.S. citizen, Judge Reggie Walton of the District of Columbia District Court ruled Thursday.
Muthana, 25, left her family home in Alabama and dropped out of school in 2014 after making contact with ISIS fighters through social media. She was born to a Yemeni diplomat in 1994 and was issued an American passport despite eventual confusion about when her father's diplomatic post officially came to an end.
Muthana burned her U.S. passport in 2014 and declared herself to be a part of the caliphate, using social media to encourage others to join too. She married an Australian-born ISIS fighter who was killed in 2015 and then married a Tunisian-born fighter who was also killed, but with whom she had a son. Muthana also married and divorced another fighter.
During the brief hearing Thursday afternoon, the judge heard arguments from Christina Jump, who was representing Hoda Muthanas father Mohammed Ali Muthana, and from DOJ attorney Scott Stewart, who was appearing on behalf of the State Department and the U.S. government. Waltons surprise ruling came after a fifteen-minute recess. The judges quick decision may have been based on the recent shifting and uncertain conditions in Syria he referenced in his opening remarks. Walton said hed issue a written opinion within 30 days.

Breathed a sigh of relief on this decision. President Trump’s refashioning the higher Courts will give us some breathing room as we fight to save our Constitutional Republic.
As I understand it, her dad was a diplomat. Their children do not get birthright citizenship. There was a question about the timing of her birth and her dad’s leaving his assignment which led to her incorrectly getting a US passport.

Children of diplomats or soldiers of other nations do not get birthright citizenship. It’s been that way since the beginning.

There is some perversity in the fact that, if her father was an illegal alien, she’d be a “Dreamer” and would get all the associated bennies.
Maybe she should claim he was faking the diplomatic gig and was actually illegal.

The exception might be if the spouse is a citizen of the hosting nation. The child could get dual-citizenship under certain circumstances. Boy meets girl in foreign nation, has a child together, the child could be a citizen of both the parents countries.
There are those that say she was an anchor baby. Here is a prime example of why babies born in the US to non-US citizens should not be granted citizenship.

I am thinking that the judge got a call from somebody in ICE that said “Yeah, if you let her back in, POTUS would like nothing better than a nice high profile TREASON trial right after we arrest her for it when she sets foot in US soil. It’s gonna be great to hear the Islamic Squad members and the dens defend this ignorant b-—!”.

It is possible to be born in the US and not a citizen. In this case, the passport is issued by mistake.

She renounced her citizenship and pledged loyalty to the Caliphate. Not a citizen count 1. Also was born to a foreign diplomate in the US, but is expressly not a real citizen, hence the need to have a passport issued. Not a citizen count 2.
