Police trying to determine if Ohio homeowner was justified in killing two teens

The families of two teenagers who were shot and killed after allegedly trespassing outside a home in Dayton, Ohio, are demanding accountability. The homeowner admitted he shot Javier Harrison and Devin Henderson on Wednesday. Police said the teens may have been involved in drug activity on the property.

Police are trying to determine whether this is a case of justifiable self-defense. Jimmy Harrison, Javier Harrison's father, said the unidentified homeowner knew his son, but police haven't confirmed that.

"I want answers," Jimmy Harrison said.

Harrison said he feels like the shooting was premeditated.

"It wasn't in your house, it was in the garage," Harrison said. "You seeing some perps out there at your garage, you know, so my first instinct is call the police. I feel like he took the law into his own hands."

The homeowner told police he saw a light in his garage Wednesday and found three people sitting inside a car. Police said he fired his revolver multiple times, killing the two teens. The third person ran away but returned when police arrived.

On the other hand, and totally theoretically here, what would you have done in this situation? Asking for a friend...

I probably would not have shot anybody, or even shown a weapon. "Get off my lawn!" would be the best starting move. From about 30 feet away, and a position of cover, with weapon at low-ready.

If there was movement toward me or any visible weapon brought out then things might get kinetic in a hurry. It wouldn't be a good time for a long conversation.

Embellishing what we know with imagined details to artificially construct a scenario where there is enough room in your mouth for your feet to wiggle your toes doesn’t help your point at all.

All excellent advice. And I recommend if you carry, get something like this.

It will be worth the 10 bucks a month to have free lawyers available for any gun or weapon ‘incident’.

Disclaimer: I am not a law shield salesman, have no stock in it, but I am a client. I hope I never have to use a gun in self defense, but I never have to worry about those million dollar legal fees if I do.

Well you seem to have your head up your ass, because you have misconstrued everything from the article and my responses.

What exactly do you think I made up? What I posted is exactly lifted from the news article. The man shot at the youths in the vehicle in the garage. The light was on. So what is it that I have made up? Liar. Nothing was embellished. Yet you seem hellbent on insulting other freeper members without cause. Stick to the facts.

Something similar happened to a lady at church.

Here's one where the homeowner shot someone coming into his dark garage. What's bad is that it was his teenage daughter. What was worse, is that he was a Sheriff's deputy, and was stupid.

Yes, I agree. On the surface it sounds suspicious, a la Oscar Pistorius.

I didn't follow the case to know the outcome. The mother was, understandably devastated, and stopped attending our church. She didn't want to revisit the event over and over with every expression of sympathy by the parishioners.

Were you ever in the military? Haven't you ever deeply thought of the circumstances that you could be presented with in which you could take a life without remorse?

When I was nineteen out of high school I worked on a construction crew where the owner hired ex convicts. He would not hire thieves but he would hire killers that had done their time. At lunch one of them asked another one why he killed that man in a bar. The other answered, "he needed killing."

In spite of God's commandment, I know I could do it and I know I'm not the only human since the dawn of man that has been honest with himself.

I'm not saying I would have done as this homeowner has done. I don't think I would allow myself to live in a place like that, having been raised in a rural and small town life.

Let me explain something about the police in general in the Dayton area and the Montgomery county sheriff's office. It's my opinion that any citizen is their enemy! They have bought into this disgusting hero worship that has infected this country. They are not nice people and think little of the people they rule, and if u even talk back to them like u are a citizen and u know your rights they will do everything in their power ,in my opinion, to see u get screwed.

Oh, and how about the cops that let a drugged crazy steal their SUV and kill 2 children and injure 11, or about the killing of a woman by an officer chasing a vehicle on Springboro pike. I believe police in this area are TOTALLY out of control and dangerous. This should be investigated at the highest levels of government in Ohio; but won't be.

Oh, and I forgot to add that 2 of the people shot in the recent Dayton shooting were supposedly shot by police!

Then again, we seem to have a lot of “kill them because we can get away with it” types spouting off here....without any real care about whether or not people needed to/deserved to die..
My Dad taught me respect for human life even as he taught me about guns and how to shoot...was with him one time when a guy came to the car while we were stopped at a red light...the guy showed a knife and told Dad to give him his wallet. Dad reached towards his back pocket and came up with his 1911 and asked the guy how much he really needed...could have shot but knew he didn’t have to...the guy backed up until he tripped on the curb and sat down and Dad chuckled and we continued on our way.
Way too many bloodthirsty idiots here.

I do not and never in my 70+ years have ever had any thing in my garage that is worth killing in one for stealing it. If it was a detached garage, he should have armed himself and called the police. He will pay a lawyer more than the garage and all its contents just to stay out of jail and that is if he is lucky.

Besides, I would not want to have the deaths of 3 people on my conscience for the rest of my life.

That’s good advice generally but when a catastrophic event like this happens, people are more likely to give their version of what happened. A person who is justified in self-defense but then tells the police on the scene that “I won’t talk to you without first consulting an attorney” will automatically raise a flag of suspicion . . . maybe it wasn’t self-defense. Where it truly is “self-defense”, starting with those very words seems important, “fear for one’s life”, descriptions of any threatening behavior w words by criminal etc. and don’t talk beyond the facts. Shooting someone for being a stranger and in one’s garage seems not enough for self-defense. Could be manslaughter. It is not a position any law-abiding person would ever want to experience.

So what?

You cannot talk your way out of an arrest. You can all too easily talk your way into one. Officer Friendly is there to arrest somebody. Just stop talking. The Police know the rules. Most of the time, they will follow them.

Observe that when Police are involved in a shooting, the very first thing they do is lawyer-up. The union representative tells them not to say another word to anyone, including fellow officers. Ordinary citizens are well-advised to follow the same procedures.

Ending a life? No big deal if you are acting in defense of you life and/or defense of another.

Too many TV programs and movies make it a highly emotional event. . .when it is not.

My son shot a drug smuggler that tried to kill him. Son was okay and proud of what he did, and rightly so.

Policy required three shrink sessions so he went. Thought it was a waste of time, after all, he was trained to do what he did, he did it correctly and was not bothered at all. The shrink, wimpy therapist required my son attend an additional session of therapy. Why, he asked, was told he did not show enough remorse for killing a drug smuggler. The therapist watched too many TV/movies that paint some silly picture that taking a life was an emotional event. Son saw it differently, as he was trained to do what he did, did it correctly and had no remorse. No call for remorse, he shot the bad guy that was trying to kill him.

What about soldiers? They go to war, shoot bad guys and come home. . .MOST do not suffer PTSD.

It is NOT something that you think it is (”ending a life and living with it”). Big deal. Living with it is the right thing to do. No remorse for a low life scumbag losing his life. . .I guarantee you that the scumbag wouldn’t have any remorse for killing you or your family

If a person breaks into your home it’s clear cut - you have the right to defend yourself.

In the garage situation what makes it tricky is that he confronted the criminals and might have been afraid for his life... in which case he would get a pass. You can’t just kill people because they’re on your property.

Hope neither one of us will experience such a situation and the consequences of the path taken. Things are so easy by simply not talking.

The officer first asks you your name. Are you going to answer or ask for a lawyer?

I know of court cases where people (witnesses) involved in events of a crime have been arrested for delaying/obstructing an active investigation for not answering basic questions that “reasonable people” would be expected to answer under the circumstances. One case where the person (detained not arrested ... yet) said she would only answer the questions after talking to an attorney. Yes, the officer is there to arrest someone, but by arresting the “witness” too who wanted the attorney first, it was used by the DA to leverage her to testify against the actual perpetrator.
