I probably would not have shot anybody, or even shown a weapon. "Get off my lawn!" would be the best starting move. From about 30 feet away, and a position of cover, with weapon at low-ready.
If there was movement toward me or any visible weapon brought out then things might get kinetic in a hurry. It wouldn't be a good time for a long conversation.
Here is the drill:
Some comments to remember:
"I was in fear for my life".
"I am too upset to talk about that right now".
"I must speak to my Lawyer. I cannot answer any more questions right now".
Stop talking after you have mentioned your Lawyer. It can only get you into more trouble. The Police are there to arrest somebody. The more words you say, the more likely that they will hear something that justifies arresting you. You do not know what that something may be.
The Police will probably impound your weapon for evidence.. Do not argue with them. Accept that you may never get the weapon back either. Move on.
You will need that Lawyer. If you do not have one, better make that first thing you do. Get a good one with specific experience in this area. It will be expensive.
Prosecutors pick on the easy cases and tend to drop the hard ones. Being lawyered-up early makes you a hard case.
It will be worth the 10 bucks a month to have free lawyers available for any gun or weapon incident.
Disclaimer: I am not a law shield salesman, have no stock in it, but I am a client. I hope I never have to use a gun in self defense, but I never have to worry about those million dollar legal fees if I do.
