Police trying to determine if Ohio homeowner was justified in killing two teens

The families of two teenagers who were shot and killed after allegedly trespassing outside a home in Dayton, Ohio, are demanding accountability. The homeowner admitted he shot Javier Harrison and Devin Henderson on Wednesday. Police said the teens may have been involved in drug activity on the property.

Police are trying to determine whether this is a case of justifiable self-defense. Jimmy Harrison, Javier Harrison's father, said the unidentified homeowner knew his son, but police haven't confirmed that.

"I want answers," Jimmy Harrison said.

Harrison said he feels like the shooting was premeditated.

"It wasn't in your house, it was in the garage," Harrison said. "You seeing some perps out there at your garage, you know, so my first instinct is call the police. I feel like he took the law into his own hands."

The homeowner told police he saw a light in his garage Wednesday and found three people sitting inside a car. Police said he fired his revolver multiple times, killing the two teens. The third person ran away but returned when police arrived.

Not true in my state Mariner. Only a game warden can enter your property without a warrant and conduct a search outside your domicile.

In our case, they may enter an open gate but it may be locked when they want to leave.

“They can go into a detached garage, your backyard or any of your property to check out anything they find suspicious. Without a warrant. Just not into your domicile.”

You might want to consult a lawyer.

Yup. Real dogs are better than anything. Even the appearance of our German Shepherds keeps them away, much less barking and growling.

Heads off the problem, unlike guns which only help after you’re already in.

Maybe - what if they were sitting at the kitchen table in his home? As long as they doing a drug deal and feel they have a right to be there and can’t be shot?

The stupid, it burns.
Seventeen year olds can be weapons.
You have lived a blessed life, and have not everyday facts. Other people are not so lucky as to retain the ignorance from whence your posts are completely drawn.

True. Both of great promise to this nation.

Shooter will likely be convicted criminally and be burdened with millions of dollars in civil penalty.

Three guys sitting in a vehicle most likely does not present an imminent threat to life. Unless armed.

Shooter is toast. Country has two less parasites to create lifelong havoc.

Not in Texas. Fear of your life or the life of another, that is Texas law. You do not need to be in immediate fear of physical injury. Immediate means you are about to be shot or beat, if you are in your home and thugs are in your home/garage, in Texas you just have be in fear of your life.

How will we ever really know? The homeowner will have his story, and the one kid with fast sneakers will have his story, but we will never really know exactly what happened there.

On the other hand, and totally theoretically here, what would you have done in this situation? Asking for a friend...

Overt not required in Texas.
Thug talking smack and threatening, that puts you in fear of your life or the life of another that can be enough. Supreme Court says physical size or number can be used in defense of taking thugs life.

Exactly 3-1 means he was in danger. If they were that bold to be there, he had to assume they were a danger to him.

He's in trouble, if there was no weapon on the intruders.

Morally the homeowner was correct to shoot to kill.

Legally is another matter.

You have lived a blessed life, and have not everyday facts.

I disagree with your insults. Having said that, yes, I have had a blessed life. I have had a gun shoved in my face several times, and talked my way out of it without getting harmed. I've had knives pulled on me, and again, talked my way out of harm. There are other instances where I've been jumped by hoodlums and got a beat down but lived with bruises. I know very well that seventeen-year-olds can be weapons, having been at the receiving end of their fists.

But this all has nothing to do with an ignorant idiot homeowner blindly shooting away at punks in his garage because he has a trigger-happy finger. The idiot may end up in prison because he doesn't responsibly use a firearm. I hope you don't end up in a similar situation and fire first rather than use your brains.

“Three guys sitting in a vehicle most likely does not present an imminent threat to life. Unless armed.”

There is too much emphasis put on ‘armed’ or ‘unarmed’.
Remember Travon and Zimmerman? How about the Mike “the Gentle Giant” Brown in Ferguson?

Many, many people are killed each year in assaults where no weapons (armed) were used. Fists and feet (kicking) kill many people.
