Democratic presidential hopeful Elizabeth Warren on Wednesday proposed jailing executives responsible for massive data breaches.
Citing the colossal Equifax breach that compromised the personal records of nearly 150 million Americans in 2017, the Massachusetts senator recommended imprisonment for CEOs as part of a legislative proposal meant to hold corporations accountable.
Ms. Warrens bill, dubbed the Corporate Executive Accountability Act, calls for expanding existing criminal liability to negligent executives of corporations with more than $1 billion in annual revenue that are found liable for the violation of any civil law if that violation affects the health, safety, finances or personal data of one percent of the American population or one percent of the population of any state.
First-time violators would face up to 12 months in prison under Ms. Warrens bill, and repeat offender would risk up to three years if the proposal succeeds.
Corporations dont make decisions, people do, but for far too long, CEOs of giant corporations that break the law have been able to walk away, while consumers who are harmed are left picking up the pieces, Ms. Warren said in a statement, adding that passage would force executives to responsibly manage their companies, knowing that if they cheat their customers or crash the economy, they could go to jail.

Basically this would give hackers the power to put CEOs in jail.
Some CEO pisses off a Leftist politically correct hacker.
The hacker decides the CEO should be in jail. The hacker hacks the CEOs company and steals a bunch of customer data.
The CEO is charged under the law and is convicted.
This also opens up a new form of black mail. Give me money or I will hack your company and get you sent to jail.
Yeah, good luck trying to prove a modern corp CEO hasn’t done what should be done on cyber. They’ve got the board, their insurers and massive consulting firms all breathing down their necks to invest more and more in the area.
Better to go after our own guv that forced the backdoors, developed a lot of the hacking tools, did a lot of the hacking, back a lot of the hacking companies, etc., etc., if you want accountability.
The others seem just as crazy.

How about politicians who oppose border security go to jail when the border is breached? The Feds are responsible for our security and there needs to be consequences when they fail.
There wouldnt be a CEO that could keep their job longer than a year if this went into effect.

Then jail the heads of Google, Amazon and Facebook for slurping up data without our permission and intentionally sharing it with each other.
Corporations are non-jailable entities.
Personally, I would like to see some specific individual accountability for these data breeches. I want the persons most directly responsible to be held accountable.
Remember the huge OPM data breech a few years ago? The Director resigned after a lot of pressure. That's it. Very typical. Knee jerk. How about going after the system administrator types in IT that sat there and some how didn't notice the downloading of TENS OF MILLIONS of security clearance files for current and former members of the Federal government (along with cleared contractors) by the Chinese? (There may have been - and probably were - punitive internal personnel actions. But they were under reported (if they even occurred).)
That's right. Go after the truly negligent. In the case of data breeches, let the folks in IT face the music. Management may share some responsibility if problems have been previously been reported and management did not pay attention to them. But put the IT department in the direct line of fire for punishment, and whole new levels of enthusiasm for data security will emerge.
Ditto for hardware and software providers supplying defective products. (If it can be breached/hacked, it's defective.) Let the programmers and engineers sweat over the security of their products, too.
What should happen to Senators whose staff are responsible for data breaches?
