A new book on Supreme Court Chief Justice John Roberts offers new details of his negotiation with liberal justices Elena Kagan and Stephen Breyer to save ObamaCare ahead of the court's landmark ruling in 2012, according to excerpts released on CNN.
In Joan Biskupic's "The Chief" which is scheduled to release next Thursday, she writes that Roberts originally opposed upholding the Affordable Care Act's individual mandate that required people to buy insurance, and cast his initial vote to strike it down, but he did join the liberal justices in voting to uphold Medicaid expansion, according to the book. He later shifted on both issues.
"The chief justice then turned to Breyer and Kagan, the liberals most likely to work with him on contentious issues, to see if they could find common ground," Biskupic writes.
"If there was a chance that Roberts would cast the critical vote to uphold the central plank of Obamacare and negotiations in May were such that they still considered that a shaky proposition they were willing to meet him partway."
Roberts's siding with the court's more liberal justices brought him much criticism from the right. He was slammed in opinion pieces, and future President Trump condemned him on Twitter.
Roberts's reversal on the Medicaid decision allowed many Republican-controlled states to block the expansion of the program.

It’s not the job of the court to negotiate policy - Roberts should be tarred and feathered and ridden out of DC on a rail.

In other words, instead of ruling on the substance of the law and the Constitution, he ruled based on politics. Sick. He should be impeached on the basis of this - he failed to execute his position as he swore to do.

EXACTLY WHAT, pray tell, did Breyer and Kagan give in on??? Roberts is an embarrassment to the country. The Justices are there to enforce th Constitution. NOTHING ELSE. I remember that Scalia was appalled at the reversal of Roberts on Obamacare. A sad day for Constitutionalists when Obamacare was allowed to stand. Especially after Kagan herself (and she SHOULD have recused herself, but she is a Lib and they dont have to follow the Law) had argued (before her elevation to the Supremes) that the fine wasnt a tax. HOW COULD ROBERTS DECIDE IT WAS A TAX???? (I once argued this with a local morning talk show host. His position was the Justices could interpret anything however they want).
How could there ever be negotiations, when it comes to interpreting the Law?/ It is either in the Constitution or it isnt!
Article raises more questions than it answers.
Even if there’s a scintilla of truth to what’s in this book, it shows just how corrupt the judiciary is, on every level. Of course there are exceptions, but it seems, more and more, decisions are based on feelings and emotions, rather than law. Which is probably why Constitutional judges, on whatever level, are portrayed a strict, Right-Wing radicals that want to take away everyone’s rights. Which couldn’t be farther from the truth. It’s the Leftist judges that have turned our justice system into a joke, inserting their personal feelings into their decisions.
Sure would be nice if Ginsburg gets replaced some time this year and during his second term, the President can run Roberts out of town, on a rail.
