Justice Roberts’ attack against President Trump was blatantly political and wrong.

In a remarkably inappropriate and blatantly political statement Wednesday, U.S. Chief Justice John Roberts chastised President Trump for the president’s quite accurate criticism of the 9th U.S. Circuit Court of Appeals and its rogue district and appellate court judges.

The spectacle of the ostensibly nonpolitical chief justice engaged in a dispute with the president of the United States is insulting to the Supreme Court and to our system of justice.

Shame on the chief justice. What he did is unforgivable, especially after the corrosive Senate confirmation battle over now-Supreme Court Justice Brett Kavanaugh, who was the subject of bitter and baseless partisan attacks and character assassination by Senate Democrats.

I actually understand what Roberts was trying to do here. He just went about it the totally wrong way. He sees the real danger of politicizing a legal process, but his statement — if he felt obligated to make one — should have included a recognition that is country is in dire straits because people with a political agenda that has no place in our country have used the legal system to impose their own political agenda on all of us.

It's comical to see so many seemingly intelligent people here get basic facts wrong. We can't possibly fight a credible battle if we don't know what the heck we are talking about.

1. The ObamaCare mandate is basically an income tax. That's why it's administered through the IRS and calculated on your income tax return.

2. ObamaCare was introduced in the House in September 2009. The House marked up a tax bill that was originally intended for another purpose and used that as the basis for the Affordable Care Act.

It’s scary that so many who are phonies and traitors to conservative values get in positions of power.

More like: the "powers that be" will do their best to ensure that people with true conservative values do not get in positions of power. They failed to stop Trump, though.

Retrospective:

The Obamacare was not constitutional unless considered as a tax. The mandate made the law a tax.

The mandate is gone. In theory with the mandate gone, the remainder is unconstitutuinal.

Why is there not a law suit rather than floundering around with out success in the Senate?

Those are excellent points. Here's my take on them:

1. The mandate is not "gone." The 2017 tax reform bill reduced the penalty/tax to $0, but other than that the Affordable Care Act remains unchanged and the penalty/tax provision is still in it.

2. There are so many ways to win a lawsuit over various provisions of ObamaCare. Some plaintiffs have been doing just that ... the Hobby Lobby case that nobody talks about, for example. The Roberts decision -- while I hated it -- only applied to one very specific part of the law (the individual mandate). The problem is that it's not always easy to find a plaintiff who has the legal standing to mount a credible case. Here's why: If you were to file a lawsuit against ObamaCare tomorrow, what would be the basis of your case? You'd have to demonstrate that you were harmed in some way, and that's not as easy as you think. Since ObamaCare is all about regulating the health care industry it's really just state governments and insurers who would have the legal standing to challenge those regulatory provisions.

Do the other two branches of our gov’t argue and fight? We are not use to the third branch getting involved in politics altho I am told they have in decades past.

If the CJ wants the Supreme Court to get involved with politics, he picked the wrong president.
