Judge rejects Dem's bid to delay Kavanaugh vote [Sen. Merkley]
The Washington Times ^ | October 5, 2018 | Stephen Dinan

Sen. Jeff Merkley lost his bid to delay the Senate’s final vote on Supreme Court nominee Brett Kavanaugh after a federal judge ruled Friday that he had waited too long to sue.

Mr. Merkley had sued last week claiming that the president and Senate Republicans were violating the Constitution by denying him the chance to properly give vet Judge Kavanaugh’s nomination.

He said the Constitution tasks senators with giving “advice and consent” on presidential picks, and he’s unable to carry that duty out without seeing more documents from the judge’s past.

And she ruled that Mr. Merkley’s request was beyond the court’s powers anyway.

Jerk Merkley schooled on separation of powers by an 0bama appointed judge. LOL!

He and his attorneys should be disbarred for filing a frivilous suit.

No judge is going to take on a political question.

More Rat grandstanding.

You see, if you put right person in court, that person would rule in your favor. That’s why demcrats go for court because they can’t count on elections to get what they want

All Merkley did was demonstrate what a fool he was/is.

Exactly, and I doubt he even realizes it.

Unfortunately, the article doesn’t say that the judge really understood the separation of powers principle. The judge said he should have sued earlier.

The dangerous thing here is I don’t see any circumstance ever where a federal court would have the right to tell Congress that they can’t vote on something.

Since when does the judiciary have ANY control over the internal decision-making actions of the US Senate?

Robert’s Rules of Order still prevail.

He should have filed in Hawaii.

She did say it “was beyond the court’s powers.”

Exactly. An extremely shitty ruling by the Obama judge. The only proper ruling is, "If you don't like it, then withhold your consent and vote 'NO'. Court assesses costs to the plaintiff."

If the judge had tried to grant the delay, the Senate would have ignored the judge and then impeached the judge.

He should have done better judge shopping. I’m sure there is a liberal judge who would rule that the judiciary has the power to control political processes in Congress.

Since they have been able to use the courts to block President Trump’s executive orders. /s

I’m deeply disturbed by the fact that the judge ruled on timing and not separation of powers. I think if Markey had filed sooner this dipwad really WOULD have tried to stop the vote.

“...a federal judge ruled Friday that he had waited too long to sue.”

It’s preposterous that this is given as a reason at all. The Senate is a corporate body, and the Republicans hold control. The constitutional procedure has been followed.

The ruling implies that if Merkley had sued earlier, a court could have intervened. The courts have NO jurisdiction whatsoever over actions of Congress. The separation of powers affirms this.
