Unfortunately, the article doesn’t say that the judge really understood the separation of powers principle. The judge said he should have sued earlier.

The dangerous thing here is I don’t see any circumstance ever where a federal court would have the right to tell Congress that they can’t vote on something.

If the judge had tried to grant the delay, the Senate would have ignored the judge and then impeached the judge.

He should have done better judge shopping. I’m sure there is a liberal judge who would rule that the judiciary has the power to control political processes in Congress.

I’m deeply disturbed by the fact that the judge ruled on timing and not separation of powers. I think if Markey had filed sooner this dipwad really WOULD have tried to stop the vote.

It’s preposterous that this is given as a reason at all. The Senate is a corporate body, and the Republicans hold control. The constitutional procedure has been followed.

The ruling implies that if Merkley had sued earlier, a court could have intervened. The courts have NO jurisdiction whatsoever over actions of Congress. The separation of powers affirms this.

Well just impeach any judge that attempts this and remove them from office, which the Senate can do at any time it desires. The Federal Courts have no say anyway as the Senate follows its own rules, which they did and the court has no jurisdiction at all, separation of powers. What ignorant sluts these dems are. Rat brains!
