Anything implemented “by executive authority” can be rescinded by executive authority. This appeal better be more than just a suggestion. It needs to be expedited as a constitutional crisis.
Perhaps Sessions should consider thinking about maybe writing a letter of disapproval to be sent out sometime in the future.

DACA was never law. DACA was an Obama Executive Order. President Trump canceled it. A federal judge rules it be reinstated.
Sessions is spot on. The judge is way out of line.
The Pope has no battalions. He prevails on his moral authority. Federal judges are in the same boat, they have authority and respect only when they are guided by the rule of law. Liberal judges have become as partisan as the New York Times and both deserve to be ignored. When the Attorney General decides to ignore their lawless behavior, they become irrelevant. The District Judge who issued the Order said there was no “legal” justification to end DACA.
Apparently it’s illegality from the beginning doesn’t matter.
This is another reason that we need immediate confirmation to the Supreme Court and at least one more Trump appointee.

If it’s an executive order, it’s not a law, and therefore, out of the jurisdiction of the judge’s powers. The judge should be brought up on charges of obstruction of the executive branch’s legal rights to impose or repeal an executive order. No executive can function if all or any of its powers are going to be questioned and/or stopped by judges who are overstepping their bounds.
How about the good old “no standing” argument? Does a lowly district judge have the standing to run the Executive Branch? Congress can codify a big, fat “NO”
