While the case is remanded, the 9th Circuit is left with little wiggle room. This is over. The President has the authority that the Constitution gives him, and public comments cannot “trump” the Constitution and written Proclamation. This has implications for the recent temper tantrums of the Looney Left and the Press, but I repeat myself.

Judgment: Reversed and remanded, 5-4, in an opinion by Chief Justice Roberts on June 26, 2018. Justice Kennedy and Justice Thomas filed concurring opinions. Justice Breyer filed a dissenting opinion, in which Justice Kagan joined. Justice Sotomayor filed a dissenting opinion, in which Justice Ginsburg joined.
