A student has described going through mental torture after a rape case against him was thrown out in court because police had failed to hand over more than 40,000 messages from his accuser.
Liam Allan, 22, faced up to ten years in jail charged with six counts of rape and six counts of sexual assault against a young woman over a 14-month period that began when he was 19.
The criminology student at Greenwich University had spent nearly two years on bail and three days in Croydon Crown Court when the trial was stopped in a dramatic fashion after it emerged police officers had failed to hand over evidence that proved his innocence.
The alleged victim had claimed she did not enjoy sex, while Mr Allan claimed it was consensual and she was acting maliciously because he refused to see her after he returned to university.
Now, the judge has called for an inquiry at the very highest level to understand why police failed to hand over critical evidence including 40,000 messages from the accuser to Mr Allan and friends.

I do not know if prosecutors have immunity in the UK, however, private attorneys often act as prosecutors. It’s like public defenders in the U.S., mostly public officials, but an indigent defendant may be assigned a private attorney in the U.S. In the U.K. any attorney admitted to practice can be called upon to prosecute.* Some lawyers may prosecute as many cases as they defend.
It is my impression - though I cannot prove it - that British prosecutors are more committed to justice, they are not necessarily career prosecutors, and do not make their bones by taking as many scalps as possible.
*Rumpole never prosecutes.
I think I read here a few days ago:

Some prosecutors take advantage of that too.I remember one guy that sent several innocent men to death row before he was exposed. One man had already been executed but the rest of them were exonerated.

If someone doesn’t fight back and scream, isn’t threatened with a deadly weapon or isn’t drugged then it’s not rape. Any lesser standard is just going to result in endless false accusations.
The real problem is you do not always know they are crazy until later!
The answer is quite simple. In court both sides want to hide the truth from the jury. Ironic is it not, that the court is supposed to be the place truth is revealed and justice prevails. Sometimes it happens but this is not the rule of normal.

Called for jury duty once. The defense struck me due to the fact I had a background in science and medical. They did not want a logical thinker.

If you read the article, you see that she was sending him many thousands of text messages about her rape fantasies. Not hiding the crazy.
