25th Amendment attacks on Trump are “HOOEY” say Howard Dean and Jonathan Turley

On today’s Morning Joe, after accusing President Trump of “impairment,” Howard Dean said that “people keep talking about” the 25th Amendment as a means to remove the president from office. But Dean immediately poured cold water on the notion, saying “I personally think that’s probably hooey.”

Law professor Jonathan Turley agreed with Dean: “Yes, indeed, that falls under the constitutional doctrine of hooey.” Turley went on to describe the complicated procedures under the 25th Amendment, which would ultimately require a two-thirds majority in both houses of congress. Concluded Turley: “the 25th Amendment is not a really good option.”

People touting it don’t understand it. The process is far more difficult than impeachment and removal in the case of an active president.

Years ago, when he was state governor, Dean would make an appearence on Canadian TV news shows.
The Canuks would just roll their eyes thinking he was nuts...

It is. Even if Pence and the Cabinet claimed the President was unable to perform his duties, the President himself could say in writing that he was able to do so. It would then take a two-thirds vote in both Houses to remove him again. Not going to happen.

I wouldn’t give the libtards too much credit. They probably oppose assassination for the same reason, just not practical with all the secret service and stuff. These people are the “and domestic” part of “against all enemies, foreign and domestic”.

Indeed.

Although laws can always be twisted beyond their intended purpose, the basic idea of the 25th Amendment goes back to Woodrow Wilson’s stroke and Eisenhower’s heart attack. The fear was — “The president is down! He’s not dead, but he can’t govern! Who is in charge?? What will we do?? What if Russia tries to attack??”

But the Democrats now see it as a “poor man’s impeachment” tool. Hey, we don’t like this guy, so we will declare him unable to carry out his duties and then we will just move on ...”

Not so simple. If the President declares himself perfectly fit, then Congress has an extremely steep hill to climb to get rid of him. And the Second American Civil War is waiting for them at the top of that hill.

Impeachment and removal is EASIER than the 25th.

By far.

Impeachment requires only 50% +1 in the House. 2/3 of the Senate to remove.

Oddly, Impeachment and removal is easier than a veto override...which requires 2/3 of both Houses. Even though the moral threshold is far higher.
