Proposed Rules Would Allow U.S. to Track and Destroy Drones
New York Times ^ | May 23, 2017 | CHARLIE SAVAGE

The Trump administration is asking Congress to give the federal government sweeping powers to track, hack and destroy any type of drone over domestic soil with a new exception to laws governing surveillance, computer privacy and aircraft protection, according to a document obtained by The New York Times.

The draft bill’s language would authorize the government to summarily track, seize control of and use force to destroy any unmanned aircraft it determines may pose a security threat to an area designated for special protection.

The government would have to respect “privacy, civil rights and civil liberties” when exercising that power, the draft bill says. But courts would have no jurisdiction to hear lawsuits arising from such activity.

Sounds like an unconstitutional “taking” to me.
Are the drone owners going to be compensated?

" But courts would have no jurisdiction to hear lawsuits arising from such activity."

Another constitutional "right" taken away.

“destroy any unmanned aircraft it determines may pose a security threat to an area”

Good.

Doesn’t say “take”. Says “destroy”. As it should be.

You enter US territorial waters in a boat or fly into our airspace and fail to respond to requests to identify or turn around or whatever, the same thing is going to happen. Except most drones are going to be autonomous without a way to issue commands to the operator. Thus, BOOM.

The exemption from lawsuits sounds problematic. Don’t we have three branches of gov’t for a reason?

We’ve upgraded the Mothership. The latest in S.E.P. technology.

If President Trump wants to be remembered as the greatest ever, he need only expand this to include vehicles with car alarms that go off at 2 AM.

Actually the Constitution gives Congress the authority to limit the jurisdiction of the inferior courts.

They need to do it more often. Exhibit A: Immigration Law.

The only time I recall it being used recently was when George W Bush got it inserted into law exempting vaccine manufacturers from liability suits.

“Sounds like an unconstitutional “taking” to me.”

Even the government is allowed to ‘take down’ a threat to them.

This is about intercepting the communications and possibly redirecting the drone electronically.

Yes, but this isn’t that much different than other such laws. We have protected classes too.

I don’t think a judge can be sued for the things his rulings facilitate.

I believe insurance companies are protected.

We’re just the fly-over recipients of the leadership’s urine.

The way I read it they are talking about drones being
operated domestically by US citizens, not weapons from
a hostile foreign military.

Intercepting drone control communications could be considered as ‘wire-tapping’ which would need a warrant.

Allowing people to shoot the damned things down if flown over their property without permission would be a good first step.
