Politico: Trump White House Is Getting Things Ready For A Second SCOTUS Vacancy
townhall.com ^ | 4/7/2017 | Mike Vespa

This morning Judge Neil Gorsuch was confirmed to the U.S. Supreme Court. For such a non-controversial figure, Gorsuch experienced the full might of the Democratic Party’s attack machine. Still sour at Senate Republicans blocking Merrick Garland, Obama’s first pick to fill the vacancy left by the late Antonin Scalia, through the Biden rule—the Left was determined to stop Gorsuch at all costs. Despite having broad support from across the spectrum in the legal scholar realm—Obama’s former solicitor general supported his nomination—and the highest rating from the American Bar Association, Democrats formed a united front to stop him. They had the votes to block Gorsuch through a procedural hurdle, denying Senate Republicans the 60 votes needed to invoke cloture and move to the final confirmation vote. As a result, Senate Republicans nuked the rules, allowing for Gorsuch to be confirmed by a simple majority. Not liking someone because a Republican president nominated him or her isn’t a good enough reason to block a judge. Democrats learned that the hard way.

Now, should a second vacancy occur, a) Republicans will not have as much trouble to confirm this person; and b) the composition of the Court could become more decidedly conservative. This is why it was probably best for the Democrats to keep their powder dry, but we’ve crossed that bridge.

I agree with you. I expect her to quit soon after Kennedy if not before.

LOL! Yeah. I thought there might be some objection since the original storyline came through politico. ;-)

Kennedy has been the reliable swing vote---for the Dems. Replacing him with a reliable conservative judge would go a long way towards shifting the court right.

If Trump gets a second term, he will be appointing at least three more judges.

Ginsburg will hold out for a Dem President, but she is 86 years old. Father time wins every time.

If you count Breyer that could make it five Trump selections.

Kennedy and Ginsburg and there were rumors that Thomas was getting tired on the court. With Breyer that makes four more.

Can you imagine the Democrat’s and Hillary’s frustration if Trump gets to name five?

Why did she not retire under Obama?

I think Ginsberg wanted to step down last year but wanted to give Hillary the power to choose her successor. Now she’s stuck trying to live at least another four years, and maybe 8. I don’t know if she has it in her.

She has a chance. Evil witches live extraordinarily long. Maybe if we just burned her broomstick.

"Ginsburg will hold out for a Dem President, but she is 86 years old. Father time wins every time."

I'm not so sure. She had the perfect opportunity when Obama was there, but she didn't take one for the team -- even though she started showing health issues during his term.

It seems more likely that she's just a selfish person and will stay til the bitter end, regardless who the president might be...

...which is good for us -- hopefully.

Thomas wanted to retire last Summer so I would not be shocked if we hear a retirement announcement this Summer at all. It’s good to get new blood.....namely younger under 45 years old.....Yep I even thought Gorsuch was too old.

make it 11 as a preemptive strike cause there's more than a good chance when the RATS get back in power(spit) they will bump it to 11 to swing the balance in their favor

“...Kennedy shifts the balance only on social issues. Ginzberg shifts it across the spectrum....”

Excellent point.

Yeah let’s replace with a 67 year old woman who could be dead in no time. That is just stupid. Why does every person liberal and conservative never want the freaking baby boomers to FINALLY get out of our lives. The most destructive group ever to live needs to DIE for God’s sake or at least retire and get out of America’s way.

You really think Breyer is going to want to retire?

Or do they not care about the ideological shift it would cause like the politicos?

Ginsburg is pretty old so I can understand, but even know I wonder if she’s having reservations with Trump replacing her.

It’d be awesome if she did retire and somebody like Pryor replaced her.

Then again if they’re old and tired, I can see that overriding a lot of people whining to them that they have to stay on.

He should offer constitutionalists. Obama and Reid flooded the lower courts with over 360 liberal judges and the balance of power needs to be maintained.

“That should be grounds enough to force her retirement, if she can’t stay awake for a SCOTUS hearing, she is UNFIT to serve on medical grounds.”

Nonsense.

Because the 67 year old next Thomas is better than the 45 year old next Kennedy

Buzzi Ginsberg can’t stay awake long enough to hear oral argumnents, her intern s write her judgements. She is not for this world much longer.

I bet she will be the next vacancy.
