This morning Judge Neil Gorsuch was confirmed to the U.S. Supreme Court. For such a non-controversial figure, Gorsuch experienced the full might of the Democratic Partys attack machine. Still sour at Senate Republicans blocking Merrick Garland, Obamas first pick to fill the vacancy left by the late Antonin Scalia, through the Biden rulethe Left was determined to stop Gorsuch at all costs. Despite having broad support from across the spectrum in the legal scholar realmObamas former solicitor general supported his nominationand the highest rating from the American Bar Association, Democrats formed a united front to stop him. They had the votes to block Gorsuch through a procedural hurdle, denying Senate Republicans the 60 votes needed to invoke cloture and move to the final confirmation vote. As a result, Senate Republicans nuked the rules, allowing for Gorsuch to be confirmed by a simple majority. Not liking someone because a Republican president nominated him or her isnt a good enough reason to block a judge. Democrats learned that the hard way.
Now, should a second vacancy occur, a) Republicans will not have as much trouble to confirm this person; and b) the composition of the Court could become more decidedly conservative. This is why it was probably best for the Democrats to keep their powder dry, but weve crossed that bridge.

Anthony Kennedy had stated in the past that he wanted to be replaced by a Republican President because he was nominated by one (and since he's 80 this is most likely his last shot).
There were rumors floating around judicial circles the last few years that Clarence Thomas has wanted to retire in 2012 if Romney won and had told friends off the record that he didn't want to "die on the court" and was hoping for a Republican President in 2016 so he could retire young enough to enjoy his golden years.
Ruth Bader Ginsburg on the other hand? Personally I think the only way she'll be leaving the court under Trump is in a hearse, she hates Trump so much she will remain on the court if she has to rolled in on a stretcher and propped up for hearings.
I guess that would make Stephen Breyer the wild card, he is pushing 80, but seems to be in good health and there are no real rumors floating around about his retirement. So I guess we'll see...
Yes, and IIRC, Justice Scalia was immediately cremated with no autopsy. Very fishy.
I did not understand why Ginsberg did not retire during the Obama years, but there must have been a reason.
RBG and Kennedy have both expressed the opinion that international law may outweigh the language in the US constitution.
Yes, something does and I've pondered that for a long time. Sometimes I think it just comes down to personality. Ginsburg is very arrogant and a diehard feminist with an overweening sense of her place in history. She may be just to damn full of herself to ever retire voluntarily.
It's also possible that she just didn't like Barky (narcissists generally can't stand each other) and was determined to wait for the first woman president... only to have Hillary! choke and blow it.
