Politico: Trump White House Is Getting Things Ready For A Second SCOTUS Vacancy

This morning Judge Neil Gorsuch was confirmed to the U.S. Supreme Court. For such a non-controversial figure, Gorsuch experienced the full might of the Democratic Party’s attack machine. Still sour at Senate Republicans blocking Merrick Garland, Obama’s first pick to fill the vacancy left by the late Antonin Scalia, through the Biden rule—the Left was determined to stop Gorsuch at all costs. Despite having broad support from across the spectrum in the legal scholar realm—Obama’s former solicitor general supported his nomination—and the highest rating from the American Bar Association, Democrats formed a united front to stop him. They had the votes to block Gorsuch through a procedural hurdle, denying Senate Republicans the 60 votes needed to invoke cloture and move to the final confirmation vote. As a result, Senate Republicans nuked the rules, allowing for Gorsuch to be confirmed by a simple majority. Not liking someone because a Republican president nominated him or her isn’t a good enough reason to block a judge. Democrats learned that the hard way.

Now, should a second vacancy occur, a) Republicans will not have as much trouble to confirm this person; and b) the composition of the Court could become more decidedly conservative. This is why it was probably best for the Democrats to keep their powder dry, but we’ve crossed that bridge.

Lots of FReepers absolutely despise Ted Cruz. They hate his damnable guts.

Maybe we should get Cruz out of politics and put him in the Supreme Court.

Flushing Cruz from the Senate will make a lot of FReepers very happy.

I did not understand why Ginsberg did not retire during the Obama years, but there must have been a reason.

I think Thomas will announce his retirement this year. I would also not be surprised if a couple of others do not do the same in the next four years. Now that the Senate has tanked the rules it is time to start filling the court vacancies quickly to put the rats on their heels. It is also time to break up the 9th Circuit and create a new one. Fact is, far before Trump came along, that the 9th is simply too big and too slow in hearing cases.

Trump provided a list of his SCOTUS nominees - what reason do you have to believe he will deviate from that list? He has repeatedly said he will keep his promises.

I think it makes sense... she’s got the spotlight, knows it, and doesn’t want to let it go.

Might just her being vindictive too.

Either way, the passing days will make that decision for her. We’re all immortal, until we’re not anymore.

I believe that list was perceived to be a promise for the first nominee only, and the report is that Kavanaugh is being talked about. In part because like Gorsuch he had been a clerk under Kennedy. (Not a great qualification in my mind, of course...)

Trump also said he was going to replace the Scalia seat with a Scalia type. I would not be surprised ih he replaces a Kennedy seat with a Kennedy type and deviated from the list.

There’s no doubt Ruth thought Hillary was a lock. Now the only way she’ll leave is on a gurney. None of the Rats will leave before 2020 if thier health lets them. And if they think Trump has any chance they will stay past that.Let’s just pray if Trump gets another pick he keeps Ivanka and Hubby out of it. Those 2 need to go back to NY with Chelsea.

She can’t exert much influence at all. Trump is working off of his list of 20 that he said he would pick Supreme Court Justice nominations off of, and they are all conservatives (unless they turn on us like some conservative Justices have done once on the bench (Kennedy and Sandra Day O’Connor come to mind). But that’s a risk no matter who gets nominated.

My question is, have their been any cases in recent memory of liberal justice becoming more conservative, or is it always conservative justices become more liberal?

That short list was for Scalia’s replacement—and Trump followed through on that perfectly.

But he doesn’t consider himself held to the list for all possible SC nominations, and the report is that they’re communicating with Kennedy to try to ease him into hanging it up this spring, with a former Kennedy clerk with a demonstrated less-than-steel spine, such as Kavanaugh both an obvious and reported name being bandied about.

ANd not a chance Ivanka won’t be throughing her genes around on this one.

I think you’re probably right. I think lvanka and Jared want to make damn sure Roe stays and that will mean a “moderate” at best.

Excuse me, but I am a Baby Boomer (although born on the cusp of the Greatest Generation (1947), the predecessor to the Baby Boomers). Lots of your fellow Freepers are Baby Boomers. By the way, the Greatest Generation voted for FDR time after time (the grandfather of many a socialist program).

Are you saying that Millenials are any great improvement? And think Snowflakes before you cast aspersions on Baby Boomers. You wouldn’t be sitting at your computer Freeping if it weren’t for the great inventiveness of many of the Baby Boomers. Like any gross generalization, not all of the Baby Boomer generation are scum.

Kennedy had previously hinted his desire to retire in June.

Ginsberg also has hinted and her age and health underscore the possibility.
