Democrats were seething Tuesday night over President Donald Trumps decision to nominate Judge Neil Gorsuch to the U.S. Supreme Court, claiming that Trump stole the seat from President Barack Obama.
In a fundraising email, the Democratic National Committee said (original emphasis):
Judge Neil Gorsuch, Donald Trumps newly-revealed Supreme Court nominee, has a legal history that shows a deep sympathy for corporate interests and an apparent disdain for workers.
Donald wants to put Judge Gorsuch in the Supreme Court seat the GOP stole from President Obama. Add your name to tell the Senate to reject his nomination.
As an attorney, Judge Gorsuch routinely represented big businesses in class action lawsuits. As a judge on the Tenth Circuit, he wrote a concurring opinion in Hobby Lobby v. Sebelius the case that allowed employers to deny basic health care coverage to women by ruling the Affordable Care Acts contraceptive mandate was unconstitutional.

"[the President] shall nominate, and by and with the advice and consent of the Senate, shall appoint...judges of the Supreme Court..."
So, what was "stolen"? Obama nominated Merrick Garland, as was his right to do. No one disputed his authority to nominate Garland, did they?
What did not happen was Garland's appointment, and for good reason - Garland did not receive the consent of the Senate, did he?
Obama (and Trump) do not have the authority to appoint Supreme Court judges. That authority requires the consent of the Senate.
Presidents NOMINATE. They cannot APPOINT.
How can you say that after they found the Magic bullet right there on Connally's stretcher. Not to mention how well they protect VIP prisoners in Texas jails.
Garland was nominated on March 16, 2016. At the time, the upcoming March 21 debate by Fox News was canceled because Donald Trump would not attend.
Marco Rubio dropped out of the race the day before. Trump, Cruz, and Kasich remained in the race until May.
Therefore, it's wrong to say that "Trump stole the seat from Garland," as Trump had not won the primary yet when Mitch McConnell declared he would follow the so-called "Biden Rule" and not consider the nomination during the election year.

I think they mean “Republicans in the Senate” but that’s giving them a benefit of the doubt they haven’t earned.
Trump didn’t steal the seat - he won the election. That foiled their plan. Hillary was supposed to win, and Obama was supposed to take Scalia’s chair.
Thank God for Donald Trump.

I agree, it’s on a loop back in my head since Nov 9th.
Every time I read a story or thread about someone fighting anything Trump is doing, I think my tag line.
It’s the way they do it, I think. They are all being outed for what they are. And everybody is noticing.
Say what you want, we can all agree it was a strange place and crowd for him to be with that weekend.
