Court Strikes Down Obama Health Care Rule on Insurance Standards

WASHINGTON — A federal appeals court has ruled that consumers must be allowed to buy certain types of health insurance that do not meet the stringent standards of the Affordable Care Act, deciding that the administration had gone beyond the terms of federal law.

The court struck down a rule issued by the Obama administration that barred the sale of such insurance as a separate stand-alone product.

“Disagreeing with Congress’s expressly codified policy choices isn’t a luxury administrative agencies enjoy,” the United States Court of Appeals for the District of Columbia Circuit said on Friday in a decision that criticized “administrative overreach” by the Department of Health and Human Services.

At issue is a type of insurance that pays consumers a fixed dollar amount, such as $500 a day for hospital care or $50 for a doctor’s visit, regardless of how much is actually owed to the provider.

Such “fixed indemnity” insurance is normally less comprehensive and less expensive than the “minimum essential coverage” required by the Affordable Care Act. Under the rule, issued by the Obama administration in 2014, fixed indemnity policies could be sold only to people who already have the more comprehensive coverage that meets detailed federal standards.

State officials and insurers estimate that as many as four million people might have fixed indemnity policies without major medical coverage.

My wife and I have not had health care insurance since January of 2014. We’re 62. We trust completely in the Lord. We’ve also saved approximately $32,000 after tax dollars in that time.

Well, not counting the $675 in health care including prescription glasses and sunglasses and dental visits, which would not have been covered anyway.

It’s amazing the deals you can swing when you pay cash. :-)

My wife needed surgery. It was robotic surgery. They would charge the insurance company $59,000.

She didn’t have “insurance” and offered to pay cash. The surgery was $5,900 cash for the hospital + the surgeon + anesthesiologist. Under 10k total. What is wrong with this picture?

I’d love to be able to buy my old insurance, which was cancelled because it didn’t cover everything Obamacare does... things I don’t need. I used to pay $178 with major medical covered. First Obamacare pricetag was 516, then in January it went up to 726, I had to switch to an HMO... which doesn’t even allow you to fill prescriptions at normal pharmacies, and I still get to pay $450 for this luxury...

We used to call that Cost Shifting and Price Fixing, which are BOTH FELONIES!!

KD has written plenty of articles detailing these BLATANT FELONIES in the Medical Industry.

"Self Insure" and pay cash when you need medical services and you will be one of the BIG WINNERS.

Trusting in the Lord falls under the guidelines of "God helps those that help themselves."

Wow, I wish they made this Ruling back in December 2013 when our Health Insurance Policy didn’t qualify under Obamacare and we had a Defcon 4 situation replacing it.

They would charge the insurance company 59K the insurance company would look at each procedure and cost and give them about half or less.

What one charges and what one received from insurers are two very different things.

It will be interesting to see how this impacts HHS plan to limit catastrophic health coverage to a one time 90 day period. I don’t have all the particulars, but this made the news a few weeks ago..

I’ve logged many such stories from other people as well. Health care isn’t that expensive when you don’t have health care insurance.

With a $6,500 deductible it's fairly useless regardless of what it says it covers.
