(CNN) -- To hear Jackie Barden and David Wheeler describe their lives today is a master class in hope.
On December 14, 2012, Barden's youngest son, 7-year-old Daniel, and Wheeler's son, 6-year-old Ben, were among those killed at Sandy Hook Elementary School in Newtown, Connecticut.
"(My husband) Mark and I still have a great life, and we really have to remember that," Barden said, adding that their two children bring the family an enormous amount of love and strength. "We are fortunate with what we have with the two of them."
.... "Our families deserve that day in court," said Joshua Koskoff, an attorney representing nine victims' families and a teacher who survived. "We believe they should be accountable to their fair share of responsibility." .....

The article says the hearing was yesterday but I guess there was no immediate ruling on the motion to dismiss?? Also, this is the first article I’ve seen that says Remington is the target of the suit. I’d understood it was another AR-15 pattern rifle used in the attack.
Any judge who applies the Constitution and the law AS WRITTEN would throw this lawsuit out so fast the attorney's head would spin like Sybil's. Unfortunately, too many judges see lawsuits like this as their avenue for effecting political changes that they favor but the constitutional political process would never accomplish; therefore, they allow idiotic twists of illogic to enter the argument and then rule that the law or the constitution says what it clearly does not say. Then with a haughty air of an imperial monarch, the judge states "this is my ruling, and it is beyond disputation."
Will they sue GM when a Chevrolet runs over an innocent person and kills him? Just as logical.
I agree. Judges want to make law without the consent of the people. They are in essence, petty tyrants.
I remember a case decades ago where a pregnant woman and her husband got into 2 bumper cars at a Florida theme park and, despite signs banning the practice, he rammed his wife’s car, head on, causing her pain. She sued him and the theme park. Since the husband had no money the park had to cough up all the dough, like a half a mil. Park closed soon after.
How about suing your government and school system for not keeping them safe?

OK, a little time with Bing and now I see that the suit is against Freedom Arms which owns both Remington and Bushmaster. I knew I’d seen another maker’s name associated with this suit.
How about suing the government, who denied thier 2nd Amendment rights, by making a school a gun free zone.
So someone steals my car,

Yeah, I’m sure that the school was a “gun free zone”. The state didn’t do enough to assure that that law was enforced.

The judge “hopes to rule in 60 days” on whether the trial can proceed to discovery. A firstie in law school ought to be able to figure this out in a quicker time than that.

any judge which takes a case like this IS the problem

What if the Government knowingly released illegal immigrant murderers into the general public, would they not be clearly responsible for any further murders?
I do not see how Nancy Lanza could have given permission for her son to use the AR15 since she was dead.
Because Sandy Hook was a hoax and they needed to destroy the evidence?
