The Constitution Does Not Require the Senate to Vote on a Nomination

Senator Schumer appeared Sunday on ABC's This Week and responded to suggestions that the Senate might not confirm the lame-duck President's nomination to replace the late Justice Scalia: "show me the clause [in the Constitution] that says [the] president's only president for three years."

True, Presidents serve four-year terms. But here's a question for Senator Schumer: Can you show me the clause that says the Senate must vote on, let alone confirm, a President's nominee?

I'll save him the effort: There is no such clause in the Constitution

Less than a decade ago, Schumer advocated doing the same exact thing if any additional Supreme Court vacancies opened under former President George W. Bush.

I saw the video in 2007 with Schumer telling bush not to make any SCOTUS appointments ( Actually, I wish he hadn’t) But can you believe rubio loves Schumer?

I followed the nomination fiasco at the time. Estrada was one of about half a dozen. Frist helped bury most of them after the gang-of-14 (led by McCain) action.

New York Sen. Charles E. Schumer, a powerful member of the Democratic leadership, said Friday the Senate should not confirm another U.S. Supreme Court nominee under President Bush "except in extraordinary circumstances."

"We should reverse the presumption of confirmation," Schumer told the American Constitution Society convention in Washington. “The Supreme Court is dangerously out of balance. We cannot afford to see Justice Stevens replaced by another Roberts, or Justice Ginsburg by another Alito."

Last year Reid changed the rules to end filibusters on judicial appointments.

Now he and the rest of the hypocrites are demanding the Senate 'confirm', as Sanders put it, Obama's SCOTUS pick. And claiming the republicans are blowing up the Constitution if they don't.

But they will be sorely disappointed and have to manufacture their own Reichstag fire, because they have so succeeded in dumbing down the people that America will end with a whimper, not a bang. we are witnessing it as we type. Somebody should ask Schumer why Obama said in July of 2008 that he would be POTUS for “the next 8 to 10 years”.

Obama was never a VP who filled out the last (under) 2 years of his President, so he can only have 2 terms. How was he thinking he would get the extra 2 years? Couldn’t come before his 2 terms so it would have to come after his 2 terms. What would have to happen late in his 2nd term, for him to continue on for another 2 years instead of a new POTUS taking office.......?

Somebody needs to ask ALL the DC critters that.
