Sotomayor, Kagan: Hobby Lobby Should Drop Insurance, Pay Penalty and Let Employees Use Exchange

During oral arguments in the U.S. Supreme Court on Tuesday which focused on whether the contraceptive mandate in the Affordable Care Act violates the free exercise of religion, Justices Sonia Sotomayor and Elena Kagan suggested employers who have moral objections to birth control should not provide health care coverage for their employees

Chief Justice Roberts interjected that this was in opposition to what Hobby Lobby presented in its lawsuit. “I thought – I thought that part of the religious commitment of the owners was to provide health care for its employees,” Roberts said and Clements agreed. “Well, if they want to do that, they can just pay a greater salary and let the employees go in on the exchange,” Sotomayor said. The court seemed divided along ideological lines

It might help fire up the “drop employer coverage, institute single-payer” crowd.

[ Traitor Roberts still is a Traitor. ]

I still think that Roberts was Blackmailed over this with a standing order that he go against it and they expose whatever hidden skeletons they have found in his closet.

I think they have been running him like a puppet eversince they found dirt on him.

Am I crazy thinking this isn’t a bad idea?

I mean, if you must be under the thumb of this law.

But this begs a question: if this new socialist law basically says everyONE must sign on for insurance (NOT care), why should a whole company be subject to this law? Isn’t it supposed to be that individuals are forced to get it?

So why would a company have to pay extortion fee for “not signing up”? Why would it as a corp have to sign in for insurance?

And apparently so are the churches. Why should the Court stand up for religious rights when the churches don't. Mainstream Protestants have allowed homosexuals, promiscuity, pedophilia, and other "former" sins to fester with in it's ranks. The Roman Catholic Church continues to allow politicians who espouse abortion to take communion. Most Americans don't even go to church anymore. We reap what we sow.

Wow, they sure are hard up for getting people to join those exchanges. Of course nothing in their argument even remotely relates to the Constitution of the United States of America, but it goes a long way towards addressing the political ends of this White House. The Administration is woefully short of reaching its enrollment targets, so they need Hobby Lobby to help them out a bit on this one.

“If you’re poor, you can go to Planned Parenthood. If you’re not poor, the cost for contraceptives is just not that costly.”

That isn’t the point for these people.

The perception of “The Christian War against WOMEN!!!” is far more important to these liberal ideologues than who pays for a $4 contraceptive.

Hmm, i wonder if it would be better in the long run if Hobby Lobby loses. Better in the sense it would drive public outrage, and increase the chance of getting of of Obamacare.

No thanks. Camel's nose and all.

As mentioned in related threads, activist justices don’t want anybody to find out that the Supreme Court had previously clarified that the states have never delegated to Congress, via the Constitution the specific power to regulate, tax and spend for public healthcare purposes.

No they will use the savings from not being able to offer the Health Care they wish to, to pay for the fine or tax or penalty whatever the heck they call it.

They already offered insurance that worked for them and their employees but because of Obamacare they will have to pay more for less.
Just because you are a Judge does not mean you are logical.

It’s not anyone’s imagination if they see the left trying to get EVERYONE dependent on government.

Rush mentioned this today - nothing makes a leftist madder than when someone avoids being in the collective.

The court isn't there to decide solutions, only to rule on the legal aspects.

Good luck to any employee who does not want insurance that covers Sandra Slut's abortion, because, there is none under zerOcare.

Getting rid of Obamacare is no longer enough. We now have a parasite culture that will elect MORE of these Marxists in order to get stuff through new laws. Look at how persistent this disastrous piece of garbage has been even with all that has been revealed about it.

Nothing short of civil war to restart this country and purge it of the parasites will suffice.

Roberts said it was a tax. You cannot religiously exempt yourself from paying taxes, say, because they are used to fight wars.

But there are certain entities that are exempt from taxes, such as churches.

Unfortunately, I think Hobby Lobby loses.
