Few people are as unpopular on the right at Chief Justice John Roberts. He is viewed as having legitimized Obamacare. But did he?
My understanding of the "leiu" (the law, according to Inspector Clouseau) is that for a suit to have merit there must first be a harm. Keep that in mind.
Matt Sissel currently has a suit against Health and Human Services on appeal claiming that Obamacare, since it was ruled a "tax," in fact violates the Constitution's origination clause that all tax bills must originate in the House. According to Andrew Kostler at the Heritage Foundation, the concept has merit.
The difficulty, he argues, is that often courts don't want to get into the legislative one-upsmanship. However, Sissel's case will come up for review soon.
According to Kostler, the Origination Clause was breached. It was first introduced on in the House as a resolution called the "Service Members Home Ownership Tax Act of 2009." The House passed that measure, but the Senate used it as a vehicle for a health-care overhaul. The House bill in the Senate was "gutted almost entirely" and retitled the "Patient Protection and Affordable Care Act," passed in 2009.
If the appeals court rules in Sissel's favor, he could obtain an injunction.
Personally, I think a real case will await the first imposition of a real tax penalty or fine in January which would generate a new, possibly stronger case. If that occurs, Roberts could very well have been admonishing conservatives to get on the stick when he said that it wasn't the Court's job to correct bad legislation and may have been winking and nodding a message: "you have the means right now to stop this once I deemed it a tax and no one objected."
It will be interesting to see where this path leads.

They were of course from his wifes family''s home town in Cork County, Ireland. He smuggled them into the states and got busted by the regime.

The title and text of a law as passed by the House should
be a read only constant value. The Senate should be required to make their version changes as an appendix referencing
the original without alteration. The gutting practice should render the origin invalid.
SCOTUS? It is no more. Its officially dead.
These rumors have been circulating ever since the Obamacare ruling.
The problem is that there does not appear to be one shred of evidence to support the whispers, either about the adoptions themselves or about alleged blackmail.
Using Wikipedia as a source just doesn’t cut it.
The kids, at 13, are old enough now that I doubt Ireland would push to have any claim over them. The cat’s already out of the bag so what’s holding him back from claiming he signed it during duress? If he’s worried about his reputation and his wife’s, well, they’re already going down in history as slimy lawyers so speaking out could only do him good. Speaking out would also guarantee nothing evil would befall his family whereas not speaking out would always be the threat and more blackmail.
Of course it SHOULD, but what will courts say about this argument?

Ok. For the record-—although I didn’t post links-—this was a topic of discussion on H-CONSERV list site among academics that in fact there were solid-—if somewhat weaker-—challenges to Ocare still pending.

So what. It’s a clear violation of the Tenth Amendment. What Roberts did was declare the Tenth null and void as long as the government used taxes to enforce it’s decrees. Roberts e even had to twist things to call this a tax. Any thinking person can see that the ACA penalty doesn’t qualify as a tax. Roberts is evil or an idiot. Same goes for his defenders.

Once in a great while you might get a chance to be a real life hero, Roberts can now tell his kids, family and friends what he did when his chance arrived. He totally screwed the pooch, got it so entirely wrong his name will be worse than Mudd to any future generations.
