I would say that Prop 8 is in trouble.

With Reagan’s Kennedy the poissible key, I am not encouraged. Or maybe Kennedy’s vote won’t be needed at all. Kennedy was really a Ford man; so was O’Connor. Ford said John Paul Stevens was his greatest accomplishment in public life, but he forgot to thank Reagan for Kennedy and O’Connor.

If Prop 8 fails...it opens the door to the question of every single proposition in California that has passed over the last forty-odd years. You could use the same challenge of wording and take down dozens of voter-passed laws. I think all of the justices are looking at this side of the mess....if you open the door enough....you just invite more business and more undoing on the part of the Supreme Court.

If Prop 8 is thrown out, why bother voting? The majority can have their say, but if the minority doesn’t like the outcome, they can sue to overturn. Might as well kiss the republic goodbye. It will be gone.

gay people, if they are citizens, have the same rights as any body else, nothing more, nothing less.

They are not “special” “cool” and are far from enlightened and I wouldn’t wish the belief that one is “gay” on any of my friends or family. I doubt your hope for your child is that they are “gay”. You might hope they become a doctor, or you might hope they strike it rich, but I doubt you would hope they become “gay”.

Voters should have the final say on proposition 8.
The court should not meddle with what the people themselves decided.

My prediction is DOMA is tossed, but the states will retain the power to define marriage, so Prop 8 will stay. Of course, this depends on how compromised Roberts is.. after he effectively re-wrote the Obamacare mandate case to fit that pre-determined “it’s a tax” outcome... who knows?

The voters should have to vote on DOMA.

Put the question on the next Presidential ballot.
Let the people decide what they want.

I keep wishing someone on talk shows would PUSH the point, that when people stop going to the Court House to get marriage licenses... (tax) and go to their churches, and get a Holy Matriony Certificate validated by a board or consensus of Churches who view marriage as HOLY, then the homo’s and lesbi’s won’t want to get married, as they won’t want to pay tax, and we can shut down one of the little windows at the gov’t offices...

That's exactly what the politicians are salivating over - the possibilities of higher taxes and more revenues. A signal from SCOTUS and bye bye federal marriage exemption. The states will be soon to follow as the Politicians head to the feeding troughs. Oink Oink.

If American Families do not speak soon and loudly they minds well open their wallets and purses and say to the politicians - Help Yourselves.

You’re exactly right.

Gov’t has NO business being in the marriage ‘contract’. Like everything else, it has nosed into every aspect of life and perverts the same.

Marriage is a wholly religious institution, true. Anyone/thing else can civil-union all they like. But, dammit, get the gov’t meddling out of the tax/health/etc. code; everyone is the same/equal.

Aside from a few other areas of contention (adoption, kids, etc.), everything else goes away.
