Klamath Tribes and Feds Exercise Water Rights

Tens of thousands of acres in Oregon's drought-stricken Klamath Basin will have to go without irrigation water this summer after the Klamath Tribes and the federal government exercised newly confirmed powers that put the tribes in the driver's seat over water use — a move ranchers fear will be economically disastrous.

Klamath Tribes Chairman Don Gentry and U.S. Bureau of Reclamation Commissioner Mike Connor said Monday that they were making what is known as a "call" on their water rights for rivers flowing into Upper Klamath Lake in Southern Oregon.

British born Sally Jewell, CEO of REI and Now Interior Sec. was also one of the biggest backers of Obamacare. As soon as it was passed shes asked for (and got) and exemption for her company.

I own the MI fundraiser bucket.
They should have fought it all the way
to the Supremes. Thing is the upper reaches
of Klamath River below Klamath Falls are so
steep, that even with dams gone, salmon will
not make it to the lake. And if the tribes would catch
suckers and salmon 99.9% would would still only eat at
Mc Burger like the rest of us..Ed Hubel

The headwaters of the river is a 3X5 concrete ditch that keeps the mud flats of that pond wet so the whole valley won't smell. As for those Indians, They sold back the tribal rights. Many years later they were restored.

The indians near Palm Springs are also claiming rights to the water of the cities in that desert area.

Methinks you are confusing very rainy coastal Oregon (people don’t tan, they rust) with high desert eastern Oregon.

When all the different tribal leaders get together, they share stories about how they rolled over people in their areas, then they all go home and put each others' strategies to work.

They use the EPA to enforce rules on everyone but them, they don't pay taxes and run their own courts. They oppose development, but pave forests to build casinos. They fish or hunt in any season and are apparently not even bound by endangered species regulations. In Washington they hunt whales and they can kill Bald Eagles in Wyoming.

In Washington, they have a great scam where they sell gasoline at the same price as other stations, but they don't have to pay the high state gas tax ($.375 pr. ga.). They just pocket the difference. Governor Gregoire said she cut the deal so they wouldn't start refining their won gas and they shouldn't pay the tax, nor can they be audited because they are a sovereign nation.

In Whatcom County, the leftist social engineers are suing over well rights in unincorporated areas. The social engineers claim that the county council zoning plan allows too many wells and are not in compliance with the GMA.

The problem with their thinking is that the wells don’t impact the streams or the Nooksack River, particularly in the area of the county where I live because there is an earthquake fault which runs from Sandy Point, all along Cherry Point to the other side of Birch Bay, which is caused by two tectonic plates which come together, sliding over the inland plate, putting all the water too deep to retreive.

In this particular case, the Upper Basin farmers joined the mid-Klamath people in opposition to the Klamath agreement. The Bureau of Reclamation Project farmers made the deal selling out the upper basin farmers and the mid-Klamath people by agreeing to take these upper farmer’s water and retire their lands and by agreeing to remove the three dams in the mid Klamath. It was a violation of trust and loyalty to all of these who had supported them in 2001.

The Klamath tribe ceded it territory to the US and retained water rights for hunting and fishing. Therefore, their “time immemorial” rights trump the upper basin farmers late 1880 rights. That is why those farmers are being shut down. Wyden is trying to use this as leverage to broker a deal to get the upper basin farmers to agree to the Klamath Agreement. This will give the Klamath tribe a National Forest in exchange for some of its water rights. They also want to promise the whole upper basin better electric rates by shifting the cost onto the mid-Klamath.

I am in the mid-Klamath. This is very dirty business and involves a great deal of betrayal.

CA non=pueblo tribes had their rights extinguished under Mexico. Their reservations were created by Executive Order and do not have time immemorial standing. Water rights date back only to the date of reservation creation and only for the purpose of the reservation.
