Military Veteran’s AR-15 Confiscated by Police – But the Reason Why Is the Real Story

An Oregon man has had rifle confiscated and is facing criminal charges after he attempted to stop a wanted felon from breaking into his home by firing a warning shot.
Police in Medford, Ore., say the incident occurred at around 11:30 p.m. on Sunday. Officers responded to an apartment complex in the area after receiving a disturbance call. During their investigation, cops heard a gun shot and a man running away toward the complexs parking lot.
Authorities say 40-year-old Jonathon Kinsella, a wanted felon, was attempting to flee the scene when he was arrested on outstanding warrants, including for burglary and assault.

Press charges? The warning shot might be a sane reason to question if he was reckless.

My problem with the guy is firing a warning shot - in an apartment building(!).
For the sake of the other residents, I’d say the better option would have been to give a verbal warning - and then fire into the perps BODY, if he continued to advance, thus lessening the chance of of an innocent being hurt or killed.
My 2 cents...

I'm with you. Where did this round end up. I support the guy having the weapon, even cappin the intruder, but an apartment building doesn't provide the sort of shielding that might stop a .223 rnd from traveling into an adjacent unit. Unfortunate, but I'd say poor judgment on this guys part.

An AR-15 is a VERY poor weapon choice for Household/Apartment defense. A 12 Guage pump w/ 00 buck is a MUCH better choice. AND NEVER fire “warning” shots SHOOT TO KILL if you are FORCED to shoot. Remember “It is BETTER to be tried by 12 than carried by 6”!

Used to live in an apartment building in Arlington Va that was very popular with State Department, and various intelligence agency people ~ ours and theirs ~ simply because the builder used steel lathe as a scaffolding for hand plastered walls.
No, wouldn't stop a round, but it'd slow it down a lot, and deflect it.

Residence was an "apartment complex", from the article and looking at a picture. Perhaps they guy was on the ground floor:
"n but I was careful not to fire it at any bodys residence. It was at the ground specifically"

The cops will say that if you are only firing a warning shot you are not fearful of serious injury or death. He should have never admitted firing a warning shot.

223 is a good self defense weapon and penetrates less than some handgun or even some shotgun rounds. Search Youtube there are several good videos on various penetration scenarios. BTW the weapon of choice for me in that scenario would of been 12ga with bird shot. Very low wall penetration and very good perp stopping power.

I don’t agree with the practice of giving a warning shot (especially in an apartment!).
However, the tendency of the police to confiscate is rather concerning.
What excuses will they use to confiscate from Freepers?

I disagree. The AR15 is an excellent chooice for household defense, if you are going to use a long gun.
It has excellent intimidation value, holds plenty of ammunition, is far less likely to overpenetrate than buckshot if proper loads are selected, has less recoil and is much easier to shoot accurately.
The major problem with it is muzzle blast, which is one reason we need to remove the legal and financial barriers to effective suppressors.

Actually, many are surprised to learn that a 00 ball (.32 caliber) will penetrate drywall quite intact, while a 223 round will typically fragment when it hits drywall.

And yet, in 1934, there was an attempt to ban handguns in the US as many in Congress felt a RIFLE was a better defense weapon.
The NRA put the kebosh on that stupid idea.

Warning shots are a stupid plan! In most states you must believe you are in danger before you can shoot, and if you're really in danger you will aim at the S.O.B.
If you're into warning shots better tell them you tried but missed.
