You make a good point on de funding. I haven’t seen this opinion online, but I am thinking that what the SC said is that it could be held valid as a tax, but would need to be re-written and passed by Congress. I’m not sure I’m right, but, if this is so good luck passing a new tax in Congress in an election year.

The common thread: Lying. Roberts is OK with the President lying about whether or not he will uphold the law of the land, and OK with people lying about military service, and OK with Congress lying to the American people about whether a proposed law is a tax. No need to move the Fast and Furious scandal into the courts.... if it gets to the Supremes, Roberts’ decision is a foregone conclusion.

This is a magnificent, and accurate, post. Downticket is absolutely vital in November even if we have a thoroughly horrible Presidential candidate

Romney has ONE chance to get this right. He needs to say, today, that he will repeal this monstrosity immediately -- in full and without exception. Give the Congressional candidates something to run on.

The Tea Party has just been thrown into hyperdrive. If Romney wants conservatives on board, the Chief Weasel of the United States Supreme Court has just given him the opportunity.

The fact that states don’t have to accept new Medicaid funding, and can’t be penalized is a small victory - Roberts threw us a bone ...

...And can't be penalized....yeah, right. After what just happened in AZ...I don't believe that for a second!!

Kennedy was in favor of complete repeal, apparently. Roberts, and Roberts alone, bears the blame for this decision, because the reliably statist/liberal 4 were foregone conclusions anyway.

Megan Kelly on Fox News dramatically pronounces that Supreme Court has decisively refused Congress’s attempt to gain unprecedented power via the Commerce Clause, while failing to add that they simultaneously gave Congress that exact same unprecedented (and virtually unlimited) power via taxation.

It’s now official. America is not a free country.
