(Elyria) - A judge in Lorain County has sentenced a woman to 15 days in jail for choking a 71-year-old Wal-Mart greeter who asked to see a receipt as the woman left the store.
Elyria Municipal Judge Lisa Locke graves sentenced 49-year-old Toni Duncan on Thursday for what she calls the “absolutely reprehensible” attack last March. Duncan was sentenced after pleading no contest and being found guilty of assault.
According to the Elyria Chronicle-Telegram, the defendant also was ordered to take an anger management course by year's end and stay away from the Elyria Wal-Mart and the victim for five years.
The woman's 23-year-old daughter was sentenced to three days in jail for disorderly conduct and also was ordered to stay away from Wal-Mart for five years.

Being me, I'd probably get loud and ask them if they could prove I didn't steal the underwear I had on, volunteer to go watch any video they had to back up their claim of a stolen cell phone, and inquire as to whose ass I got to kick when I was vindicated. But that's just me. The thing about thieves is that they, too, will profess innocence.
And then use all those cameras that Wal-Mart has to actually catch the guys doing it. Call the cops, and insist, as a larger taxpayer in the community that they show up quickly. Or hire off-duty cops.
And then bust the perps (internal or external) cleanly and prosecute to the full extent of the law, holding the DA's feet (and future political contributions) to the fire, so he gets serious about it.
Instruct my PR people that we'll get bad PR from the news and that they will be hated, and they should get over it.
Make some examples, hard. Of real bad guys. And watch the problem go away.
If sued for discrimination, fight hard, spend millions, don't give up.
Either that, or close the shop and deal with communities that don't have that problem.

Exactly so. They should have charged her with “elder abuse”. She would have gotten 10 years for that.

One knows going in what the drill is upon leaving, so entering is implied consent to being politely asked for a reciept, which I have no problem with.
OTOH, I stay out of places that I know will treat me like a criminal: airports; bus/train stations; or jails.
The 4th Amendment limits government power. It has nothing to do with private transactions between retailers and customers. When you go to concerts or sporting events or fly on an airline, you get searched or patted down. These are not violations of the 4th Amendment. You are of course free to avoid these places and events but it has nothing to do with the 4th restricting the power of government.

Twice a week when I board a plan my property, belongings, papers, and body are searched by the government without a warrant.
I choose not to be searched. Period. If they force it, they get the civil remedy applied.

I work for a major retailer and we have pretty much the same policy. We have morning meetings near the front door and about 10 of us had to watch someone walk out with 2 expensive items (>$500 each) and could not do ANYTHING. Just noted the items and adjusted the inventory level....
That's not Wal-Mart. I choose to not be searched. They don't search me or my property. That's the reality on the ground.

Sad that people are allowed to get away with it. They know it too. I’ve seen people pulling stuff at Wal-Mart on quite a few occasions, and I’m only a customer. People like you that work at these places must really get an eyeful every day.
We can deter the amateurs...we kill ‘em with customer service and eventually they go someplace where they won’t get that attention...but the pros—they don’t care. They’ll create a diversion or just run out the door, knowing we can’t do a thing.
“My” solution? First off, no cash refunds for no receipt returns, store gift card only. Second, tie that gift card to the ID that is presented when it is returned. There is a thriving business on eBay selling store gift cards. It is the high tech fence...and they usually get around 90% of the face value of the card....much better than they would ever get at a fence.
