Congress jumps into 'Amazon sales tax' issue

Three Democrats have introduced a federal bill that would require online retailers such as Amazon.com to collect states' sales taxes.

U.S. Sen. Dick Durbin (D-Ill) and Representatives John Conyers (D-Mich.) and Peter Welch (D-Vt.) call their proposal that was introduced July 29 the Main Street Fairness Act.

Amazon.com, which has been fighting individual states – including California – over efforts to require online retailers to collect state and local sales tax, is supporting the bill, according to a letter to Durbin from Amazon.com Vice President for Global Public Policy Paul Misener.

The way Amazon is set up, that would be a nightmare! There must be some reason they are for it. They probably figure they will end up with some of the taxes collected. Anyway, I’m done with Amazon forever. Side with dems, you are dead to me, end of story.

That the costs of collection will hit their competitors far harder than them, leaving them with a competative advantage. The reason so many CEOs and Wall Street types are Dims is because they discovered that they can legislate money into their pockets.

Catalog sales were taxes via normal sales tax if you and they were in the same state (recall those little boxes on the bottom say thing like “residents of Utah add 5%). And in most states if you weren’t in the same state you the buyer were supposed to self report. Nobody ever did of course, but you’re supposed to.

His home state had nothing to do with facilitating free commerce to its citizen, did nothing to earn that sales tax. .

I agree.... Don't feel the home state has any part of transaction.

In my state (until tomorrow, that is), Washington, you are supposed to add up all your catalog purchases and send the state a check for the sales tax. If you don’t, you are technically breaking the law.

That is really how the laws are supposed to work, but almost no one ever does that. The onus is on the purchaser, not the out of State retailer, though. To force a business to calculate sales taxes for a Governmental entity that it is not under the jurisdiction of is ludicrous on the surface.

It is possible they see this as using a club against their competitors.

I think the other possibility is that they think they are going to get clubbed with this eventually, and they prefer to pick the club. They probably also prefer for there to be a standardized federal club rather than 50 varying clubs from all the states.

What I think is particularly stupid on their part is the fact that such a bill will get stopped dead in the House anyway, so why risk ticking people off?

Notice the Marxists of party like Conyers want to increase (sales) taxes on the middle class in this contrary to their repeated claims. Notice they put the word ‘fairness’ in the title of every bill? If congressional Republicans went along with this tax increase they would deserve to lose. Socialists (OMalley Democrats) in Maryland raised the state sales tax so they would LOVE this idea.

This is probably going to come to fruition. Chamber's of commerce in every metropolis, small, and medium burgs all over the US will be backing this and pounding down the doors of their Congress beings to get it passed. I'm surprised we've enjoyed tax free Amazon et al for this long. I'll surely miss it. If you've got your eye on a big purchase I'd get it before this monster bites.

The tax issue aside my biggest concern over this is state's rights. But then individual states have long ago given up their sovereignty. Also you know state governments will be supporting this bill heavily.

Actually, the current laws apply to mail-order and internet sales.

For states that have sales taxes, they usually also have a corresponding use tax (it varies, but this is just in general).

The use tax is due on items you purchased from out of state, but didn't pay sales tax on.

Most folks don't even know about use taxes, or if they do, they don't pay them.

Catalog and mail-order companies, even the companies that sell you the thingamajig on TV for only 19.99 plus shipping and handling, will all tell you to add your state's sales tax if you live in certain states.

The rule for most state sales tax collections is that, if you have a brick-and-mortar presence in the state, then you must collect sales taxes on items sold via the catalog (now internet) mail-order services to customers within that state. Of course, this all varies by state. But ultimately it is because consumers don't follow their own state's laws and don't file to pay any use taxes due. Which is why the states are screaming.

States need the money, and they will go after it anyway they can. Just wait till this filters down to the city level.
