Justice: A 5-4 majority on the U.S. Supreme Court has just ordered California to empty its prisons of nearly a third of its prisoners because of overcrowding. The state's law-abiding citizens should be afraid very afraid.
As is often the case these days on the supposedly conservative court it's not the Brown v. Plata decision was made by four liberal justices, and one "conservative" swing vote, Justice Anthony Kennedy, who wrote the opinion.
In it, Kennedy asserted that the overcrowding has caused "needless suffering and death," upholding a decision by the notoriously wacky Ninth Circuit Court of Appeals, which has a long, inglorious record of deciding cases based on politics, not actual law.
The decision, in effect, overturns the landmark Prison Litigation Reform Act of 1995, without actually declaring it unconstitutional.
The problem with the Supreme Court's decision is that, in order to fix a problem that the state itself can fix given time, the court has once again stepped into a state's business and mandated a solution.
Currently, according to the Los Angeles Times, California has somewhere around 142,000 felons behind bars. It has already taken 9,000 out of its prison system and placed them into county jails.
Now, under the court's decision, the total will have to be reduced by as much as another 32,000 perhaps more. That means lots of criminals walking the streets.

So will your decision you idiot.
This decision is going to conflict with California’s efforts to introduce gun control.
And not a word about immediate deportation for the non-citizens. Our government is depriving us of the power to defend ourselves.
Glad I moved away from Chino when I was 14!! Lots of them will spread out to other states, might be time to buy some protection.
As bad as this is, I take comfort in the fact that Anthony Kennedy plans to stay in office for the next few years. I wouldn’t want Obama appointing his replacement.
There should be enough illegals available to be deported to meet the quota.
It’s a two-fer for the Democrats. More Democrats out on the streets before Obama’s reelection, and the increased murder rate probably means less Republican voters on a net basis.
I honestly can not see any reason to ever go to California.
Great beaches, nice landscaping and some very pretty backcountry, but none of that is worth the rest of their garbage.
“Overcrowding has caused ‘needless suffering and death’” - But the criminals cause happiness, prosperity and good health. What a bunch of dipshits. Turn ‘em loose on the law abiding citizens. Ship ‘em all to the Justice’s neighborhoods. Then, you’d see some hollering for locking them up. If even one person is harmed by turning these thugs loose, then these five justices will have blood all over their hands and pretty black gowns. It’s easy to be magnanimous when it doesn’t affect you personally. When it’s your property that gets stolen or the gun gets waved in your face, well, then, reality kicks you in the ass and all that brotherhood and rehabilitation crap goes out the window.
Hey...these justices have security protecting them. what do they care?
Does IBD ever publish anything original - or just rehashed news?
How many will head to San Fran.? Can they send a contingent to the Pelosi vineyards?
This would have the names and addresses of members of California's ACLU.
Arranging to get it passed out to prisoners might be a bit difficult, but you only need to get ONE copy inside each prison and the prisoners will take care of that.
Now I have to go and buy even more ammo!
Released prisoners will migrate to states with the most strict gun control laws.....Where they will promptly acquire a weapon and resume their trade....
These leftist leaders are truly criminal for not simply cutting all government employee wages accordingly to fix the budget crisis. How dare they mess with public safety!
