Order Blocks Oklahoma Constitutional Amendment

A temporary restraining order has been issued to block a state constitutional amendment that prohibits state courts from considering international or Islamic law when deciding cases. U.S. District Judge Vicki Miles-LaGrange handed down the ruling this morning in Oklahoma City following a brief hearing.

Looks like Oklahoma has some serious work ahead.

That makes two states, now, Arizona, Oklahoma, and soon...Texas, if they pass a law similar to Arizonas, as they have been debating.

Fly over country is about to get its dander up.

Nobody tried to “ban Islam”, rather they banned a theocratic legal and political system (Sharia law). How in the world could that conflict with the first amendment?

I can't say for certain, having not seen whatever actual order was handed down, but at the very least, I believe there would be a problem with the fact that the law bans only *a* theocratic legal system.

It doesn't restrict judges' use or implementation of papal law, or Jewish law, or Bahai law, or Hindu law. Judges can still rely on any of those varieties of religious law. Rather, it singles out just one particular type of religious law, Islamic law, and then says that Oklahoma courts have to treat that religious law different from any and all other religious law.

And that definitely puts it in conflict with the First Amendment.

That was then. This is now. At one time we had a Constitution. We still have one, but a majority of voters said ,via their votes, the hell with the Constitution! We want the government to take care of us from the cradle to the grave.We do not want to be free to make decisions about our lives. Give us free health care,free housing free money, free daycare, free abortions. use the force of government to steal it from those who earned it. We don’t care if 90% of it goes into your pockets just give , give , give ,give to us. Take our soul.

Does everyone feel that way? No. But they have allowed the parasites to gain a foothold.

If you get a chance, look up the state question—actually it does ban others by way of stating “or any other foreign” laws, or similar words. It does point out Sharia, but not exclusively.

First off, the ban against the use of international law wouldn’t cover religious law. International law is the formal creation of states and treaties, not religious groups.

Now after the proposal singles out Sharia law in particular, the next sentence states “The courts shall not look to the legal precepts of other nations or cultures.” For nations, that’s straightforward enough.

But if that’s meant to encompass other religious law besides Sharia, then at the very least you’ve got a serious problem with vagueness. What qualifies as “other” cultures? Is Jewish or Old Testament law “other”? Is papal law? (For that matter, Roman law? English common law? Native American tribal law? That last one could be a big problem for courts in Oklahoma, in judging Indian disputes.)

And if not all religions are deemed “other,” then the consequence of that is that Oklahoma has created a law that respects a particular establishment of religion. Namely, whatever establishment they have not formally deemed to be an “other” religion.

Yea. But, Islam is a theocracy. All laws within a nation of Islam is based first, on Islamic law. IOWs, Islam is the supreme law of the land, first and foremost. Since there are numerous Islamic nations, with laws based first and foremost on Islamic law, these are Islamic states and nations. As such, they are both.

In order to defend ourselves against Islamic law in America, we may be forced to pull a Pelosi. "“…We will go through the gate. If the gate is closed, we will go over the fence. If the fence is too high, we will pole vault in. If that doesn’t work, we will parachute in.”

Whatever it takes, any recognition of Sharia law in our courts must be prevented. We don't stone women for adultery, we don't make women wear burkas and veils, we don't behead folks for violations of our laws, we don't chop off the fingers of thieves. You know the score.

Finally, the last time I checked, the Romans, nor the Jews, nor the Native Indians, nor the English, were seeking to destroy the USA. Islam is. And I don't mean just the extremists. I mean all of Islam. Anyone in denial of this reality needs to remove their blindfolds.

Singling out, and preventing any semblance of Sharia law In America may need to overcome some legalese loops, but it must be done.

I heard a news story on KTOK at the top of the hour. They reported that the primary reason that the judge issued the order was that the State Election Board did not file a brief... Oh, by the way, Paul Ziriax (the director) is a democrat appointee. The outgoing AG is a democrat.

Ya know, the more I think about this, the more it angers me. Are the outgoing Dems are setting us up?

If that is the case there is no problem with a constitutional amendment stopping any consideration of it.

Miles-Lagrange and Fallin both served as Oklahoma State Senators in the Oklahoma legislature about the same time. Lagrange was very popular with the black voters in the senate district she held that lay mainly in the N.E. OKC where the Black population traditionally has congregated.

Mary Fallin was also a popular State Senator, then Lt. Governor, then U.S. Rep. However, although a Republican, I don’t think she has the ump to tell the federal courts to pound sand.

Take heart about one thing. This is only a temporary restraint pending a full hearing. It was probably a token jesture on the part of Miles Lagrange.

The Ayatollah Khomeini once said, “Islam is politics or it is nothing.” Islam is about the merger of state and “church” in such a manner that no dissent is tolerated. Nothing could be more hostile to secular law, religious freedom, basic human rights, and our Constitution. Islam teaches hatred, discrimination and violence against Jews, Gentiles, Infidels, Buddhists, Americans —— even against other Muslims. There are similarities between Islam and Nazism. Allowing mosques or sharia courts in the United States is similar to tolerating outposts of Hitler’s National Socialism during World War II.

To give just one example: Currently in Saudi Arabia no religion other than Islam is tolerated. The Koran is their constitution and Shari’a is their law. Religious freedom does not exist. Nothing like our Bill of Rights exists. This is the opposite of the rights enjoyed by American citizens under our Constitution.

Congress should identify Islam as a subversive organization.
