With all the talk of many conservatives hoping that Mark Rubio could one day run for President, I have a few questions. From the information available on the Web, It is said that Mark Rubio's parents were here in exile from Cuba. That would imply that they had hopes of returning there one day. Did his parents ever become US citizens? Did they become US citizens prior to Mark's birth?
WOW! Reminds me of algore gesturing emphatically and stating: Global Warming is a fact, science is settled!!

This statement illustrates that many people making these arguments are not lawyers, or if they are lawyers, they should be disbarred because they don’t understand very elemental concepts of statutory construction.
First, you fail to understand the importance that the 14th Amendment was enacted after the ratification of the Constitution and Article 2. The 14th Amendment is not some lesser part of the Const. It is as much a part of the Const. as Acticle 2, Section 1. Since the 14th Amendment became part of the Const. after Art. 2, the drafters of the 14th were aware of Art.2, they are presumed to have modified it (if indeed it was a modification) and the latter modification will control.
Second, since the latter enacted section (the 14th) controls, it will be interpted according to the plain meaning of its words. The words about being born here are clear. The “subject to the jurisdiction” means to exclude such foreigners who are here on a diplomatic mission, who have diplomatic immunity. They are not subject to the jurisdiction of the States. If Rubio’s and Jindal’s parents were not “subject to the jurisdiction” of the states in which they were residing, then guess what? All the illegal and legal immigrants in prison for commiting violations of state statutes, such as murder, should be released immediately because a State has no juridiction over them according to this logic.
This brings up the last point. Statutes are construed to avoid absurd results and to be harmonious. There is nothing in the text of the 14th to indicate that the drafters intended to create two diffenent types of citizenships for people who are born here, i.e. ‘naturally born here’ and simply ‘born here’ citizens.
I realize this is going to fall upon deaf ears, but just as people who don’t understand how the body works aren’t able to give a valid opinion on how to perform surgery, people who don’t understand how the law works aren’t able ...

Yes, nothing in Art. 2, sect.1. prevents Anwar al Alwaki from being President.
I’m sure that his birth certificate doesn’t have an asterisk saying he’s a born citizen, but not a “natural born” citizen. In fact, I’m not aware that any such document exists for anyone. Are you aware of anyone having such a document? That ought to tell you something.

Wow....the dems must really fear Marco Rubio. This is a non issue if I ever heard one.
BTW, his father (Mario) died in September and was a registered voter, but I do not know when he became a citizen.
My point is simply that the expression “natural born citizen” could be taken to court and actually could be found to mean: “both parents citizens at time of birth.”
Obama would not have passed that hurdle, I would have welcomed it, and to be consistent, I would have to same the same, regretfully, about Rubio.
However, it’s not as if being a Senator or Governor would be a terrible thing for Rubio. After all, there’s no guarantee than any potential candidate automatically gets to be president.
I don’t think the media will hit Rubio hard...yet. They are using surrogates, avoiding the obvious hypocrisy of not looking into obie’s background.
Lotta talk coming before the horse there. If Obama doesn’t have a Valid US birth certificate, then all your talk is moot.
And he’s yet to provide one.

Netherlands, Switzerland as basis for US legal system? To be used to determine the elibibility of a candidate for office in 2008?
You are trying to cite the “laws” of ancient royalty to define the eligibility for modern, elected civilian office, in our constitutional republic.
Either the Constitution defines “Natural Born” differently than “Native Born” or it doesn’t.
Period. If it doesn’t, it will be up to the USSC to decide, and I believe it would rule as does the article in the Congressional Record.
Natural Born = Native Born.
Obama and Rubio can by President, that way; but not George Romney.

There is nothing wrong with Marco being married to a former Dolphin Cheerleader, she is the strong woman behind the great man. The Dolphin cheerleaders have a background that includes being led by prestigious names in Dancing and Choreography.
Our New Lt Governor Jennifer Carroll(an Immigrant from Trinidad) has a son that is a Rookie corner-back for the Dolphins. Things are good and getting better.
Marco is great! It is his type of character that is winning back our country. And I would love to have a wife or even girlfriend similar to his wife! God willing someday...if I deserve it.
When liberals attack us for small things - then push a porn-peddler forward as one of their heroes (like Larry Flynt) it works in our favor. The only people who buy their double standard are the folks in the MSM. The 'people' are disgusted with those kind of liberal antics. My hope and prayer is that dems once again fall into that trap - they think it works because the press falls for it. What they don't understand is that the press will fall for ANYTHING they come up with... and everyone knows it.
That’s not what it means. If it did it would be redundant to put it in the Amendment.
