Citizen Assaulted for Filming Governor John Kitzhaber Event (Oregon)

Approximately 10 minutes into the speech the moderator informs the public not to film. The citizen continues to film, stating it is his First Amendment Right. The camera is smashed into his face. This is clearly seen on the video.

Uh...The freedom to assemble doesn't mean "freedom to assemble film footage."

I guess some FReepers think that it's okay to do whatever you want on someone else's property. When invited to a public event, one can't just behave however one wants. The First Amendment addresses religious freedom, too, but I bet you wouldn't hear too many FReepers yell "First Amendment!" to support the right of a Satanist to start rituals in their church while he attends a meeting that was open to the public. Surely they would have the right to ban such things as a condition of attendance. This isn't a shopping mall.

There's also the copyright issue. Perhaps the church was going to sell DVDs of the event to recoup costs of advertising and security, or whatever.

Too many conservatives forget that when they leave these principles behind, the Left takes advantage of it.

The problem here is the potential assault and battery. But calling the police could have gotten the cameraman in trouble, too, as it seems he might have been in violation of the law, too.

IANAL, though.

You cannot assault someone for filming you.

You can call the police and have them removed.

Varies from state to state, and by situation, I'm sure. Security can often apprehend shoplifters, people violating rules, etc.

I wish camera guy had simply said, “No sir! You have no authority to tell me to stop filming! This is a free country, and I am a free man!”

That puts the sorry-arse thug in his place, and does so without any erroneous pleas for protection of the First Amendment.

Remembering the John Ziegler/USC incident. A private property owner has a right to ask you to stop filming while on their property and to have you removed if you fail to comply. Physical battery did take place, though. Sounds like we need a beer summit.

That might be it, but I think the people who took the camera should have explained that.

I know at my church we have had public officials come and talk at varies Forums, and we usually sell a professional DVD afterwords.

The First Amendment contains no guarantee of a right to film a speech.

But see, this is the problem with the Bill of Rights, and why so many good and wise men opposed it.

The Constitution carved out an “area of authority” from within the people’s freedom. But the Bill of Rights, by its very existence and in spite of the Ninth and Tenth, carves out instead an “area of freedom” from within the government’s authority - the precise opposite of the “republic of freedom” which the Constitution was intended to provide.

This fellow needs no constitutional amendment. He is a free man, in a free country. An amendment protecting his “right to film” serves only to abridge - by its very existence and specificity - his other, not-so-protected rights.

Just tell those black thugs to “buzz off or I’m calling the cops!”

This short of thing is going to continue until there is are a number of high visibility instances where the thugs in question are tracked down later and beaten to within an inch of their lives.
